The nuclear weapon is, in many ways, the negation of the humanitarian considerations underlying the law applicable in armed conflict and of the principle of neutrality.
ويعتبر السلاح النووي، من نواح كثيرة إنكارا للاعتبارات اﻹنسانية التي يقوم عليها القانون المنطبق في أوقات النزاع المسلح ومبدأ الحياد.

95. Nor can the Court make a determination on the validity of the view that the recourse to nuclear weapons would be illegal in any circumstance owing to their inherent and total incompatibility with the law applicable in armed conflict.
٩٥ - ولا تستطيع المحكمة كذلك أن تبتﱠ في صحة الرأي القائل بأن اللجوء إلى اﻷسلحة النووية غير مشروع في أي ظرف نظراً لتعارضها الطبيعي والكلي مع القانون المنطبق في أوقات النزاع المسلح.

With regard to the protection and safeguarding of the natural environment, the Court reached the conclusion that existing international law does not prohibit the use of nuclear weapons, but that important environmental factors are to be taken into account in the context of the implementation of the principles and rules of law applicable in armed conflict.
وفيما يتعلق بحماية البيئة الطبيعية والحفاظ عليها، خلصت المحكمة إلى استنتاج مفاده أن القانون الدولي القائم اﻵن لا يحظر استخدام اﻷسلحة النووية، على أنه يجب أن توضع العوامل البيئية الرئيسية في الاعتبار في سياق تنفيذ مبادئ وقواعد القانون المنطبق في أوقات النزاع المسلح.

Certainly, as the Court has already indicated, the principles and rules of law applicable in armed conflict - at the heart of which is the overriding consideration of humanity - make the conduct of armed hostilities subject to a number of strict requirements.
وبالتأكيد، كما سبق للمحكمة أن ذكرت، فإن مبادئ وقواعد القانون المنطبق في أوقات النزاع المسلح - وفي صميمه الاعتبار اﻷعلى وهو اعتبار اﻹنسانية - تجعل سير أعمال القتال المسلح خاضعاً لعدد من الشروط الصارمة.

As to subparagraph D of paragraph (2) of the operative paragraph, the statement that a " threat or use of nuclear weapons should also be compatible with the requirements of the international law applicable in armed conflict ... " suggests the possibility of cases of compatibility and consequently of legality.
وفيما يتعلق بالفقرة الفرعية دال من الفقرة )٢( من المنطوق، فإن القول إنه " يجب أن يكون التهديد باﻷسلحة النووية أو استخدامها متمشيا مع مقتضيات القانون الدولي المنطبق في أوقات النزاع المسلح ... " يوحي بإمكانية وجود حالات يتمشى فيها ذلك مع هذه المقتضيات وبالتالي يكون مشروعا.
