Vessels flying the flag of a State not cooperating with the relevant subregional or regional fisheries management organization or arrangement shall not fish contrary to the conservation and management measures established by that organization or arrangement.
على السفن التي ترفع علم دولة غير متعاونة مع منظمة دون إقليمية أو إقليمية مختصة أو ترتيب دون إقليمي أو إقليمي مختص لادارة مصائد اﻷسماك ألا تقوم بالصيد بما يتعارض مع تدابير حفظ مصائد اﻷسماك وإدارتها التي وضعتها تلك المنظمة أو ذلك الترتيب.

The terms of participation in such organization or arrangement shall not preclude such States from membership or participation; nor shall they be applied in a manner which discriminates against any State or group of States having a real interest in the fisheries concerned.
ولا تمنع أحكام الاشتراك في تلك المنظمة أو ذلك الترتيب أن تمنع الدول من العضوية أو الاشتراك، ولا تطبق تلك اﻷحكام بشكل يكون فيه تمييز ضد أي دولة أو مجموعة من الدول تكون لها مصلحة حقيقية في مصائد اﻷسماك المعنية.

4. Only those States which are members of such an organization or participants in such an arrangement, or which agree to apply the conservation and management measures established by such organization or arrangement, shall have access to the fishery resources to which those measures apply.
٤ - لا يكون الوصول الى موارد مصائد اﻷسماك التي تنطبق عليها تلك التدابير متاحا إلا للدول اﻷعضاء في تلك المنظمة أو المشتركة في ذلك الترتيب، أو التي توافق على تطبيق تدابير الحفظ واﻹدارة التي تضعها تلك المنظمة أو ذلك الترتيب.

2. Such State shall not authorize vessels flying its flag to engage in fishing operations for the straddling fish stocks or highly migratory fish stocks which are subject to the conservation and management measures established by such organization or arrangement.
٢ - ليس لتلك الدولة أن تأذن للسفن الرافعة لعلمها بالدخول في عمليات لصيد اﻷرصدة السمكية المتداخلة المناطق أو اﻷرصدة السمكية الكثيرة الارتحال الخاضعة لتدابير الحفظ والادارة التي وضعتها تلك المنظمة أو ذلك الترتيب.

4. Only those States which are members of such an organization or participants in such an arrangement, or which agree to apply the conservation and management measures established by such organization or arrangement, shall have access to the fishery resources to which those measures apply.
٤ - لا تكون فرص الوصول الى موارد مصائد اﻷسماك التي تنطبق عليها تلك التدابير متاحة إلا للدول اﻷعضاء في تلك المنظمة أو المشتركة في ذلك الترتيب أو التي توافق على تطبيق تدابير الحفظ واﻹدارة التي تضعها تلك المنظمة أو ذلك الترتيب.

٢ - لا تأذن تلك الدولة للسفن الرافعة لعلمها بالدخول في عمليات لصيد اﻷرصدة السمكية المتداخلة المناطق أو اﻷرصدة السمكية الكثيرة الارتحال الخاضعة لتدابير الحفظ والادارة التي وضعتها تلك المنظمة أو ذلك الترتيب.

41. A State which does not cooperate with a relevant subregional or regional fisheries management organization or arrangement shall not authorize vessels entitled to fly its flag to operate in fisheries which are subject to conservation and management measures established by that organization or arrangement.
١٤ - لا يمكن للدولة التي لا تتعاون مع منظمة دون اقليمية أو اقليمية مختصة أو ترتيب دون اقليمي أو اقليمي مختص لادارة مصائد اﻷسماك أن تأذن للسفن التي لها الحق في رفع علمها بأن تعمل في مصائد اﻷسماك الخاضعة لتدابير حفظ وادارة وضعتها تلك المنظمة أو ذلك الترتيب.

2. Such flag State shall not authorize vessels flying its flag to engage in fishing operations for the straddling fish stocks or highly migratory fish stocks which are subject to the conservation and management measures established by such organization or arrangement.
2 - لا تأذن دولة العلم تلك للسفن الرافعة لعلمها بالدخول في عمليات لصيد الأرصدة السمكية المتداخلة المناطق أو الأرصدة السمكية الكثيرة الارتحال الخاضعة لتدابير الحفظ والإدارة التي وضعتها تلك المنظمة أو ذلك الترتيب.

6. Any State intending to propose that action be taken by an intergovernmental organization having competence with respect to living resources should, where such action would have a significant effect on conservation and management measures already established by a competent subregional or regional fisheries management organization or arrangement, consult through that organization or arrangement with its members or participants.
٦ - على أية دولة تعتزم اقتراح إجراءات لتتخذها منظمة حكومية دولية لديها صلاحيات فيما يتعلق بالموارد الحية، حيثما يكون لتلك اﻹجراءات أثر كبير على تدابير الحفظ واﻹدارة التي سبق أن وضعتها منظمة دون إقليمية أو إقليمية أو ترتيب دون إقليمي أو إقليمي ﻹدارة مصائد اﻷسماك، التشاور من خلال تلك المنظمة أو ذلك الترتيب مع أعضاء في تلك المنظمة أو المشاركين في ذلك الترتيب.

٦ - أية دولة تنتوي اقتراح إجراءات لتتخذها منظمة حكومية دولية لديها صلاحيات فيما يتعلق بالموارد الحية، عليها، حيثما يكون لتلك اﻹجراءات أثر كبير على تدابير الحفظ واﻹدارة التي سبق أن وضعتها منظمة دون إقليمية أو إقليمية أو ترتيب دون إقليمي أو إقليمي ﻹدارة مصائد اﻷسماك، التشاور من خلال تلك المنظمة أو ذلك الترتيب مع أعضاء في تلك المنظمة أو المشاركين في ذلك الترتيب.

35. Vessels flying the flag of a State not cooperating with a competent regional fisheries organization or arrangement should not fish contrary to the terms of the conservation and management regime established by that organization or arrangement and a non-party should not issue a licence or permit to its vessels allowing fishing within the regulatory area.
٣٥ - على السفن التي ترفع علم دولة غير متعاونة مع منظمة إقليمية مختصة أو ترتيب إقليمي مختص لمصائد اﻷسماك ألا تقوم بالصيد بما يتعارض مع أحكام نظام حفظ مصائد اﻷسماك وإدارتها الذي وضع من جانب تلك المنظمة أو ذلك الترتيب. ولا ينبغي لغير اﻷطراف إصدار ترخيص أو تصريح لسفنها للصيد داخل المنطقة الخاضعة للنظام.

In application of the precautionary approach, in December 2008, the fishing authorities of the Republic of Korea issued an Administrative Directive for Implementing International Regulation regarding Bottom Fishing in the High Seas to regulate bottom fishing activities in areas where there was no RFMO/A or process for the establishment of such an organization or arrangement.
