3. Following a request made pursuant to this chapter, a State Party in which illicitly acquired assets are situated shall:

One speaker noted that there was no common denominator in cases of grand corruption where illicitly acquired assets were returned to the countries of origin; he stressed that one of the unique achievements of the Convention was its holistic and integrated approach, addressing, in a single instrument, the prevention of corruption, the freezing of assets, international cooperation and asset recovery.

2. Each State Party shall adopt such measures as may be necessary, in accordance with its domestic law, for financial institutions within its jurisdiction to apply enhanced scrutiny in order to improve the detection of illicitly acquired assets.
2- تعتمد كل دولة طرف ما قد يلزم من تدابير، وفقا لقانونها الداخلي، لكي تجري المؤسسات المالية الواقعة ضمن ولايتها القضائية فحصا مشددا لأجل تعزيز إمكانية كشف الموجودات المكتسبة بصورة غير مشروعة.

States Parties shall also consider taking such measures as may be necessary to permit their competent authorities to share that information with the competent authorities in other States Parties when necessary to investigate, claim and recover illicitly acquired assets.
وعلى الدول الأطراف أيضا أن تنظر في اتخاذ ما قد يلزم من تدابير للسماح لسلطاتها المختصة بتقاسم تلك المعلومات مع السلطات المختصة في الدول الأطراف الأخرى عندما يكون ذلك ضروريا للتحقيق في الموجودات المكتسبة بصورة غير مشروعة والمطالبة بها واستردادها.

(d) The illicit acts constitute minor offences or the illicitly acquired assets are of a de minimis value.
(د) اذا كانت الأفعال غير المشروعة تمثل جرائم طفيفة أو كانت الموجودات المكتسبة بصورة غير مشروعة ذات قيمة ضئيلة.

وتنظر كل دولة طرف أيضا في اتخاذ ما قد يلزم من تدابير للسماح لسلطاتها المختصة بتقاسم تلك المعلومات مع السلطات المختصة في الدول الأطراف الأخرى، عندما يكون ذلك ضروريا للتحقيق في الموجودات المكتسبة بصورة غير مشروعة والمطالبة بها واستردادها.

" (a) Permit the requesting State Party to initiate legal action in the courts of the requested State Party for the purpose of establishing the ownership of illicitly acquired assets located in the territory of the requested State Party, by presenting either:
" (أ) أن تسمح للدولة الطرف الطالبة بأن ترفع دعوى أمام محاكم الدولة الطرف متلقية الطلب لغرض اثبات ملكية الموجودات المكتسبة بصورة غير مشروعة والموجودة في اقليم الدولة الطرف متلقية الطلب بأن تقدم إما:

" (b) Permit its competent authorities to give effect to a final judgement of a competent court of the requesting State Party ordering the confiscation of illicitly acquired assets located in the territory of the requested State Party;
" (ب) أن تسمح لسلطاتها المختصة بانفاذ حكم نهائي صادر عن محكمة مختصة في الدولة الطرف الطالبة يأمر بمصادرة الموجودات المكتسبة بصورة غير مشروعة والموجودة في اقليم الدولة الطرف متلقية الطلب؛

" (e) Adopt such measures as may be necessary to ensure the prompt return of illicitly acquired assets to the requesting State Party; and
" (ﻫ) أن تعتمد ما قد يلزم من تدابير تكفل إرجاع الموجودات المكتسبة بصورة غير مشروعة إلى الدولة الطرف الطالبة على وجه السرعة؛

" (f) Consider adopting other measures necessary to facilitate the prompt recovery of illicitly acquired assets and their restitution to the requesting State Party. "
" (و) أن تنظر في اعتماد تدابير أخرى ضرورية لتيسير استرداد الموجودات المكتسبة بصورة غير مشروعة وردها إلى الدولة الطرف الطالبة على وجه السرعة. "

" 3. The affected State, after receiving the returned illicitly acquired assets, shall be responsible for making payments to the victims, potential claimants or rightful owners or other rightful recipients within the State and, in that regard, the affected State shall pass the necessary legislation.
" 3- يتعين أن تكون الدولة المتضررة، بعد تلقي الموجودات المكتسبة بصورة غير مشروعة والمرجعة، مسؤولة عن تقديم مدفوعات إلى الضحايا أو الطالبين المحتملين أو المالكين الشرعيين أو لسائر المستفيدين المستحقين داخل الدولة ويتعين أن تقوم الدولة المتضررة باصدار التشريعات الضرورية في هذا الشأن.
