If a forgery is committed by a person who is not a public official or equivalent, the prescribed penalty is 15 years' imprisonment and a fine of 300 dinars, in accordance with article 175 of the Criminal Code.
أما إذا ما ارتكب الزور من قبل شخص ليست له صفة الموظف العمومي أو شبهه، فان العقوبة المستوجبة تكون السجن مدة خمسة عشر عاماً وخطية قدرها ثلاثمائة دينار وذلك طبقاً لمقتضيات الفصل 175 من المجلة الجزائية.

The difference between article 259 and articles 256 and 257 is that the latter two require that the public official or the magistrate make a corrupt commitment to perform, delay or refrain from performing an act relating to their duties.

It shall be considered torture if a civil servant or equivalent orders, incites, consents to or is silent about torture in the course of or in connection with the performance of his job.
ويعتبر معذباً الموظف العمومي أو شبهه الذي يأمر أو يحرض أو يوافق أو يسكت عن التعذيب أثناء مباشرته لوظيفته أو بمناسبة مباشرته له " .

Iraq stressed the fact that the national policy on ethics and conduct of public officials was aimed at ensuring the objectives of public office, namely, service for all, without trading in public office, using it as a means of illicit gain or a means of personal influence for the public official or other persons.
80- وشدد العراق على أن سياسته الوطنية ازاء أخلاقيات وسلوك الموظفين العموميين ترمي إلى تأكيد أهداف الخدمة العمومية، وهي بالتحديد خدمة الجميع دونما متاجرة بالمنصب العمومي واستخدامه وسيلة لكسب غير مشروع أو سبيلا لنفوذ شخصي من جانب الموظف العمومي أو غيره.

215. Article 103 of the Criminal Code prescribes a penalty of 5 years' imprisonment and a fine of 5,000 dinars for any public official or equivalent who violates the personal freedom of another person without legal justification or who directly or indirectly inflicts violence or ill-treatment on a defendant or witness or expert in order to obtain a confession or a statement.
215- ويقتضي الفصل 103من المجلة الجزائية أنّه يعاقب بالسجن مدّة خمسة أعوام وبخطية قدرها خمسة آلاف دينار الموظف العمومي أو شبهه الذي يعتدي على حرية غيره الذاتية دون موجب قانوني أو يباشر بنفسه أو بواسطة غيره سوء معاملة ضد متهم أو شاهد أو خبير بسبب إدلائه بتصريح للحصول منه على إقرار أو تصريح.

(b) The solicitation or acceptance by a public official or any other person, directly or indirectly, of an undue advantage for himself or herself or for another person in order that the public official or the person abuse his or her real or supposed influence with a view to obtaining from an administration or public authority of the State Party an undue advantage.
(ب) قيام موظف عمومي أو أي شخص آخر، بشكل مباشر أو غير مباشر، بالتماس أو قبول أي مزية غير مستحقة لصالحه هو أو لصالح شخص آخر، لكي يستغل ذلك الموظف العمومي أو الشخص نفوذه الفعلي أو المفترض بهدف الحصول من إدارة أو سلطة عمومية تابعة للدولة الطرف على مزية غير مستحقة.

(a) The promise, offering or giving to a public official or any other person, directly or indirectly, of an undue advantage in order that the public official or the person abuse his or her real or supposed influence with a view to obtaining from an administration or public authority of the State Party an undue advantage for the original instigator of the act or for any other person;
(أ) وعد موظف عمومي أو أي شخص آخر بأي مزية غير مستحقة أو عرضها عليه أو منحه إياها، بشكل مباشر أو غير مباشر، لتحريض ذلك الموظف العمومي أو الشخص على استغلال نفوذه الفعلي أو المفترض بهدف الحصول من إدارة أو سلطة عمومية تابعة للدولة الطرف على مزية غير مستحقة لصالح المحرّض الأصلي على ذلك الفعل أو لصالح أي شخص آخر؛

17. As part of the cooperation efforts with the Committee against Torture, the Tunisian legislature reviewed the Criminal Code and added article 101bis by Law No. 89 of 2 August 1999 which stipulates the following: " Any public official or equivalent found guilty of subjecting any person to torture while in the line of duty or while conducting official business shall be sentenced to eight years in prison.
17- في إطار التجاوب مع لجنة مناهضة التعذيب، تدخّل المشرّع التونسي ليُطوّر المجلة الجزائية ويضيف الفصل 101 (مكرّر) إليها، بموجب القانون رقم 89 لسنة 1999 المؤرخ في 2 آب/أغسطس 1999، والذي ينصّ حرفياً على ما يلي: " يعاقب بالسجن مدّة ثمانية أعوام الموظف العمومي أو شبهه الذي يُخضع شخصاً للتعذيب وذلك حال مباشرته لوظيفة أو بمناسبة مباشرته له.

" (a) The solicitation or acceptance by a public official or any other person, directly or indirectly, of any undue advantage for himself or herself or for any other person in order that the public official or the person abuse his or her real or supposed influence with a view to obtaining from an administration or a public authority of the State Party any undue advantage or any favourable decision for himself or herself or for any other person;
" (أ) قيام موظف عمومي أو أي شخص آخر، بشكل مباشر أو غير مباشر، بالتماس أو قبول أي مزية غير مستحقة، لصالحه أو لصالح أي شخص آخر، لكي يسيء ذلك الموظف العمومي أو الشخص استغلال نفوذه الفعلي أو المفترض، بهدف الحصول من إدارة أو سلطة عمومية تابعة للدولة الطرف على أي مزية غير مستحقة أو أي قرار محابٍ، لصالحه أو لصالح أي شخص آخر؛

" (b) The promising, offering or giving to a public official or to any other person of any undue advantage, directly or indirectly, in order to induce the public official or the person abuse his or her real or supposed influence with a view to obtaining from an administration or a public authority of the State Party any undue advantage or any favourable decision for the original instigator of the act or for any other person;
" (ب) وعد موظف عمومي أو أي شخص آخر بأي مزية غير مستحقة أو عرضها عليه أو منحه إياها، بشكل مباشر أو غير مباشر، لتحريض ذلك الموظف العمومي أو الشخص على إساءة استغلال نفوذه الفعلي أو المفترض، بهدف الحصول من إدارة أو سلطة عمومية تابعة للدولة الطرف على أي مزية غير مستحقة أو أي قرار محابٍ لصالح المحرّض الأصلي على الفعل أو لصالح أي شخص آخر؛

The working group adopted the proposal of Mr. Sik Yuen that the words “the status of civil servant or any other” be deleted from the text so that the sentence reads as follows: “Membership of the Committee is incompatible with any other post or function subject to the hierarchical structure of the executive authority of a State Party.”
واعتمد الفريق العامل اقتراح السيد سيك يوين الداعي إلى حذف عبارة " مركز الموظف العمومي أو أي منصب " من النص بحيث تصبح الجملة كالتالي: " تتعارض العضوية في اللجنة مع أي منصب آخر أو وظيفة أخرى تخضع للهيكل اﻹداري للسلطة التنفيذية لدولة طرف " .
