In the case of a transboundary movement deemed to be illegal traffic as the result of conduct on the part of the importer or disposer, the State of import is to ensure that the wastes in question are disposed of in an environmentally sound manner by the importer or disposer or, if necessary, by itself.
وفي الحالة التي تعتبر فيها حركة نفايات خطرة ونفايات أخرى عبر الحدود اتجاراً غير مشروع لكونها نتيجة تصرف قام بها المستورد أو المتخلص، تضمن دولة الاستيراد أن يتولى المستورد أو المتخلص، أو هي ذاتها عند اللزوم، التخلص من النفايات قيد النظر بطريقة سليمة بيئياً.

In the case of illegal traffic (as defined in article 9, paragraph 1), the country of export shall ensure that the wastes in question are taken back into the country of export for their disposal or disposed of in accordance with the provisions of the Basel Convention.
في حالة الاتجار غير المشروع (كما ورد في المادة 9، الفقرة1)، يضمن البلد التصدير عودة النفايات قيد النظر إلى بلد التصدير للتخلص منها أو يتم التخلص منها وفقاً لأحكام اتفاقية بازل.

In the case of illegal traffic (as defined in Article 9, paragraph 1), the country of export shall ensure that the wastes in question are taken back into the country of export for their disposal or disposed of in accordance with the provisions of the Basel Convention.
وفي حالة الاتجار غير المشروع (كما ورد في المادة 9، الفقرة 1)، يضمن بلد التصدير عودة النفايات قيد النظر إلى بلد التصدير للتخلص منها أو يتم التخلص منها وفقاً لأحكام اتفاقية بازل.

Article 8 provides that, in such cases, " the State of export shall ensure that the wastes in question are taken back into the State of export, by the exporter, if alternative arrangements cannot be made for their disposal in an environmentally sound manner, within 90 days from the time that the importing States informed the State of export and the Secretariat, or such other period of time as the States concerned agree " .
وتنص المادة ٨ على أنه، في هذه الحالات، " تضمن دولة التصدير قيام المصدر بإعادة النفايات قيد النظر الى دولة التصدير إذا تعذر وضع ترتيبات بديلة للتخلص منها بطريقة سليمة بيئيا خلال ٠٩ يوماً من تاريخ قيام دولة الاستيراد بابلاغ دولة التصدير واﻷمانة، أو خلال فترة زمنية أخرى تتفق عليها الدول المعنية " .

4. In cases where the responsibility for the illegal traffic cannot be assigned either to the exporter or generator or to the importer or disposer, the Parties concerned or other Parties, as appropriate, shall ensure, through cooperation, that the wastes in question are disposed of as soon as possible in an environmentally sound manner either in the State of export or the State of import or elsewhere as appropriate.
4- في الحالات التي لا يمكن فيها إسناد مسؤولية الاتجار غير المشروع إلى المصدِّر أو المولِّد أو المستورد أو المتخلِّص، تضمن الأطراف المعنية أو أطراف أخرى حسب الاقتضاء، من خلال التعاون، التخلص من النفايات قيد النظر بطريقة سليمة بيئياً بأسرع وقت ممكن سواء في دولة التصدير أو دولة الاستيراد أو في مكان آخر، حسب الاقتضاء.

However, where responsibility for the illegal traffic cannot be assigned either to the exporter or generator or to the importer or disposer, " the Parties concerned or other Parties, as appropriate, shall ensure, through cooperation, that the wastes in question are disposed of as soon as possible in an environmentally sound manner either in the State of export or the State of import or elsewhere as appropriate " (art. 9 (4)).
غير أنه في الحالات التي لا يمكن أن تنسب فيها مسؤولية الاتجار غير المشروع الى المصدر أو المولد أو المستورد أو المتصرف " تضمن اﻷطراف المعنية أو أطراف أخرى، حسب الاقتضاء، من خلال التعاون، التخلص من النفايات قيد النظر بطريقة سليمة بيئياً بأسرع ما يمكن سواء في دولة التصدير أو دولة الاستيراد أو في مكان آخر، حسب الاقتضاء " )المادة ٩)٤((.
