220. armed robbery against ships, as defined in the draft Code (see para. 197), constitutes an offence under article 3 of the 1988 SUA Convention, article 6 of which requires a State party to establish its jurisdiction when the offence is committed against or on board a ship flying its flag, in its territory, including its territorial sea, or by one of its nationals.
