Other delegations expressed the view that it would be premature to do so and that the Scientific and Technical Subcommittee needed to be given sufficient opportunity to assess the problem of space debris appropriately before the issue could be considered by the Legal Subcommittee.

At its latest session, the Subcommittee had concentrated on the topic of measurements of space debris and had initiated the preparation of a technical report, which would be updated every year.

It also agreed with the Subcommittee that it could be desirable to compile information on various steps taken by space agencies for reducing the growth or damage potential of space debris and to encourage common acceptance by the international community, on a voluntary basis.

It also noted that the Subcommittee's technical report on space debris would be updated each year, leading to an accumulation of advice and guidance, in order to establish a common understanding that could serve as the basis for further deliberations of the Committee on the matter.

Those same delegations also expressed the view that the Legal Subcommittee could concentrate on an exchange of information regarding legal implications associated with space debris, by beginning a preliminary review of existing norms in international law applicable to space debris.
وأعربت هذه الدورة نفسها أيضا عن رأي مفاده أنه يمكن للجنة الفرعية القانونية أن تركز على إجراء تبادل لﻵراء المتعلقة باﻵثار القانونية المرتبطة بالهشيم الفضائي وذلك من خلال بدء إجراء استعراض أولي لقواعد القانون الدولي القائمة والمنطبقة على الهشيم الفضائي.

The Committee agreed with the Scientific and Technical Subcommittee that consideration of space debris was important and that international cooperation was needed to further develop appropriate and affordable strategies to minimize the potential impact of space debris on future space missions.
٦٨ - واتفقت اللجنة مع اللجنة الفرعية العلمية والتقنية في رأيها القائل بأهمية النظر في مسألة الهشيم الفضائي وضرورة التعاون الدولي لمواصلة تطوير الاستراتيجيات الملائمة والتي يمكن تحمل تكاليفها للتقليل الى الحد اﻷدنى من اﻷثر الذي يمكن أن يحدثه الهشيم الفضائي على البعثات الفضائية المقبلة.

The Committee agreed that, in accordance with paragraph 37 of General Assembly resolution 50/27, it was essential that Member States pay more attention to the problem of collisions of space objects, including those with nuclear power sources, with space debris, and other aspects of space debris.
٧٨ - ووافقت اللجنة على ضرورة أن تولي الدول اﻷعضاء مزيدا من الاهتمام، عملا بالفقرة ٧٣ من قرار الجمعية العامة ٠٥/٧٢، لمشكلة اصطدامات اﻷجسام الفضائية، بما فيها اﻷجسام المزودة بمصادر الطاقة النووية، بالهشيم الفضائي، وللجوانب اﻷخرى لمسألة الهشيم الفضائي.

The Committee noted the programmes of Member States and organizations on the acquisition and understanding of data on the characteristics of the space debris environment and on measuring, modelling and mitigating the orbital debris environment, as reflected in the report of the Subcommittee (A/AC.105/637, para. 85).
١٩ - وأحاطت اللجنة علما بالبرامج التي تضطلع بها الدول اﻷعضاء والمنظمات بشأن التقاط وفهم البيانات المتعلقة بخصائص بيئة الهشيم الفضائي وعن قياس بيئة الهشيم الفضائي ووضع نماذج لها وتخفيف أضرارها، على النحو المبين في تقرير اللجنة الفرعية A/AC.105/637)، الفقرة ٥٨(.

149. Some delegations expressed the view that the Legal Subcommittee, at that session, should include in its agenda a new item entitled " Review of existing norms of international law applicable to space debris " .
١٤٩- وأعربت بعض الوفود عن رأي مفاده أنه ينبغي للجنة الفرعية القانونية، أن تدرج في جدول أعمالها لتلك الدورة بندا جديدا عنوانه " استعراض قواعد القانون الدولي الحالية المنطبقة على الهشيم الفضائي " .

The view was also expressed that the " launcher pays principle " , similar to the " polluter pays principle " in global environmental issues, should be adopted as one of the fundamental elements of a legal regime aimed at reducing space debris, and that when the principle was adopted and applied, the launcher would pay a fee which could be used for joint research activities to reduce the space debris.
٨٩ - وأعرب أيضا عن رأي مفاده أنه ينبغي اتباع " مبدأ مطلق الجسم الفضائي يدفع " على غرار " مبدأ مسبب التلوث يدفع " باعتبار ذلك واحدا من العناصر اﻷساسية لنظام قانوني يستهدف تخفيض كمية الهشيم الفضائي، وأنه بمجرد إقرار هذا المبدأ وتطبيقه، يقوم مُطلِق الجسم الفضائي بدفع رسم يمكن استخدامه من أجل القيام بأنشطة البحوث المشتركة الرامية إلى تخفيض كمية الهشيم الفضائي.

The Committee also heard special presentations by the National Aeronautics and Space Administration (NASA) on the Shuttle-Mir docking mission of November 1995, during which a video conference had taken place between the Secretary-General of the United Nations and the astronauts and cosmonauts on board, and by the Russian Space Agency on Russian activities on the space debris problem.
كما استمعت اللجنة الى عروض خاصة من الادارة الوطنية للملاحة الجوية والفضاء ناسا عن رحلة رسو المكوك الفضائي على محطة " مير " التي جرت في تشرين الثاني/نوفمبر ٥٩٩١، والتي عقد خلالها مؤتمر تلفزيوني بين اﻷمين العام لﻷمم المتحدة ورواد الفضاء اﻷمريكيين والروس الموجودين على متن المكوك، ومن وكالة الفضاء الروسية عن اﻷنشطة الروسية المتعلقة بمشكلة الهشيم الفضائي.

134. Other delegations expressed the view that it would be premature to discuss the issue of space debris in the Legal Subcommittee in view of the many technical issues that needed to be discussed in the Scientific and Technical Subcommittee, and that any recommendations resulting from the latter Subcommittee's work, begun in 1995, should be awaited.
١٣٤- وأعربت وفود أخرى عن رأي مفاده أنه سيكون من السابق ﻷوانه مناقشة مسألة الهشيم الفضائي في اللجنة الفرعية القانونية نظرا لوجود كثير من المسائل التقنية التي يتعين مناقشتها في اللجنة الفرعية العلمية والتقنية، وأنه ينبغي انتظار صدور أي توصيات يتمخض عنها العمل الذي بدأته تلك اللجنة الفرعية في عام ١٩٩٥.

The Committee took note of the working paper on the work prepared by Russian scientists on the problem of the technogenic pollution of near space (A/AC.105/C.1/L.205), submitted to the Scientific and Technical Subcommittee by the Russian Federation, and the scientific and technical presentations on the subject of space debris made to the Subcommittee by France, Germany, United Kingdom and United States and by ESA.
٠٩ - وأحاطت اللجنة علما بورقة العمل المقدمة من الاتحاد الروسي الى اللجنة الفرعية العلمية والتقنية عن اﻷعمال التي أعدها العلماء الروس بشأن مشكلة تلوث الفضاء الخارجي القريب نتيجة لاستخدام التكنولوجيا (A/AC.105/C.1/L.205)، وبالورقات العلمية والتقنية المقدمة من ألمانيا وفرنسا والمملكة المتحدة والولايات المتحدة والوكالة الفضائية اﻷوروبية عن موضوع الهشيم الفضائي.

The Committee noted with satisfaction the work of the Scientific and Technical Subcommittee on the topic of measurements of space debris (A/AC.105/637, paras. 97-137), which concentrated on the current stage of the multi-year work plan, i.e. measurements of space debris, and would be followed in the coming years by the sections on modelling of the space debris environment, risk assessment and debris mitigation measures.
٤٩ - وأحاطت اللجنة علما، مع الارتياح، بأعمال اللجنة الفرعية العلمية والتقنية في موضوع قياسات الهشيم الفضائي A/AC.105/637)، الفقرات ٧٩ - ٧٣١(. التي ركزت على المرحلة الراهنة لخطة العمل المتعددة السنوات، أي قياسات الهشيم الفضائي، والتي ستعقبها في السنوات القادمة أقسام من الخطة التي تتناول وضع النماذج لبيئة الهشيم الفضائي، وتقدير مخاطره، والتدابير الرامية إلى تخفيفه.
