20. The countervailing view, which eventually prevailed, was that a future consolidated publication should reproduce the full text of the legislative recommendations contained in the Legislative Guide.

19. The Working Group proceeded to consider the particular relationship between the draft model provisions and the legislative recommendations contained in the Legislative Guide.

2. As noted in document A/CN/9/521, paragraphs 19-21, there are essentially three options available to the Commission as regards the relationship between the draft model provisions and the legislative recommendations contained in the Legislative Guide.

64. The Chairman invited the Commission to consider the three options set forth in paragraph 2 of document A/CN.9/522/Add.1, concerning the relationship between the draft model provisions and the legislative recommendations contained in the Legislative Guide.

To the extent that the United Nations Assignment Convention addresses an issue, the recommendations contained in the Legislative Guide will be based on the principles codified in the Convention.

24. The Working Group also noted that the parts of the foreword referring to the relationship between the draft model provisions and the legislative recommendations contained in the Legislative Guide might need to be adjusted in the light of the Commission's final decision on the matter.
24- وأشار الفريق العامل أيضا إلى أن أجزاء التصدير التي تخص العلاقة بين مشاريع الأحكام النموذجية والتوصيات التشريعية الواردة في الدليل التشريعي قد يقتضي الأمر تعديلها على ضوء القرار النهائي الذي تتخذه اللجنة بشأن تلك المسألة.

Also requests the Secretary-General, subject to availability of resources, to consolidate in due course the text of the Model Legislative Provisions and the Legislative Guide into one single publication and, in doing so, to retain the legislative recommendations contained in the Legislative Guide as a basis of the development of the Model Legislative Provisions;

82. In that connection, the view was expressed that the draft model provision, while being consistent with the advice contained in the Legislative Guide (see chap. III, " Selection of the concessionaire " , para. 84), went beyond legislative recommendation 27.

Mr. Estrella Faria (Secretariat) said that document A/CN.9/522 contained notes explaining why the formulation of some of the model provisions approved by the Working Group on Privately Financed Infrastructure Projects differed slightly from that of the legislative recommendations contained in the Legislative Guide.

23. Ms. Xue Xiaohong (China) said that the practical aspect of the issue should also be taken into account; even after publication of the model legislative provisions, the recommendations contained in the Legislative Guide would continue to be a helpful tool for legislators.
23- السيدة كسو كسياوهونغ (الصين): قالت إنه ينبغي أن يؤخذ الجانب العملي لهذه المسألة بعين الاعتبار أيضا؛ إذ إنه حتى بعد نشر الأحكام التشريعية النموذجية، ستظل التوصيات الواردة في الدليل التشريعي أداة مفيدة بالنسبة للمشرعين.
