8. The Committee against Torture, acting under article 22, paragraph 7, of the Convention against Torture and Other Cruel, Inhuman or Degrading Treatment or Punishment, concludes that the facts before it constitute a violation of article 16 of the Convention.
8- وتخلص لجنة مناهضة التعذيب، متصرفةً بموجب الفقرة 7 من المادة 22 من اتفاقية مناهضة التعذيب وغيره من ضروب المعاملة أو العقوبة القاسية أو اللاإنسانية أو المهينة، إلى أن الوقائع المعروضة عليها تكشف عن وقوع انتهاك للمادة 16 من الاتفاقية.

Since the State party had failed to show that the denial of authorization met the criteria set out in article 21 of the Covenant, the Committee concluded that the facts as submitted revealed a violation of that provision.

11- وتخلص لجنة مناهضة التعذيب، متصرفةً بموجب الفقرة 7 من المادة 22 من اتفاقية مناهضة التعذيب وغيره من ضروب المعاملة أو العقوبة القاسية أو اللاإنسانية أو المهينة، إلى أن الوقائع المعروضة عليها تكشف عن وقوع انتهاك للفقرة 1 من المادة 2 والمواد 11 و12 و13 و15 من الاتفاقية.

The Committee, therefore, concluded that the facts before it disclosed a violation of the rights of Mr. Khoroshenko under articles 7 and 14, paragraph 3 (g), of the Covenant.
وخلصت اللجنة بالتالي إلى أن الوقائع المعروضة عليها تكشف عن وقوع انتهاك لحقوق السيد خوروشينكو بموجب المادة 7 والفقرة 3(ز) من المادة 14 من العهد.
