This concept is based on the well-accepted notions of territory, jurisdiction or control by a State.
ويستند هذا المفهوم إلى مفاهيم مقبولة تماماً وهي مفهوم الإقليم أو الولاية أو السيطرة للدولة.

The passage of military forces on the Earth require the permission of the state exercising jurisdiction or control over the territory concerned.
ويتطلب مرور قوات عسكرية على كوكب الأرض الحصول على إذن الدولة التي تُمارس الولاية أو السيطرة على الإقليم المعني.

While the concept of jurisdiction or control is noted, the territorial link should be emphasized wherever such link exists between activities under consideration and a State.

Each High Contracting Party will take all appropriate steps, including legislative and other measures, as required, to prevent and suppress violations of the Convention and any of its annexed Protocols by which it is bound by persons or on territory under its jurisdiction or control.

(e) " State likely to be affected " means the State in the territory of which the significant transboundary harm is likely to occur or which has jurisdiction or control over any other place where such harm is likely to occur;
(ه) يقصد بمصطلح " الدولة التي يحتمل أن تتأثر " الدولة التي يحتمل أن يقع في إقليمها الضرر الجسيم العابر للحدود أو التي تكون لها الولاية أو السيطرة على أي مكان آخر يحتمل أن يقع فيه هذا الضرر؛

(e) " State likely to be affected " means the State in the territory of which the significant transboundary harm is likely to occur or which has jurisdiction or control over any other place where such harm is likely to occur;

(4) The Commission recognized that the implication of including States exercising jurisdiction or control was that, in exceptional cases, there may be two affected States: the State upon whose territory the disaster occurs, and the State exercising jurisdiction or control over that territory regarding the same territory.
(4) وأقرت اللجنة بأن إدراج الدول التي تمارس الولاية أو السيطرة يترتب عليه، في حالات استثنائية، إمكانية وجود دولتين متأثرتين هما: الدولة التي تقع في إقليمها الكارثة، والدولة التي تمارس ولاية أو سيطرة على ذلك الإقليم فيما يتصل بالإقليم نفسه.
