Thus, paragraph 16 serves not only to reaffirm the liability of Iraq but also to define the jurisdiction of the Commission.
٧١- وهكذا لا تصلح الفقرة ٦١ ﻹعادة تأكيد مسؤولية العراق فحسب وإنما تصلح أيضا لتحديد الولاية المنوطة باللجنة.

Although the Panel has not set forth in detail its valuation of each particular claim element, it has ensured that this report clearly indicates those parts of the claims that were found to be outside the jurisdiction of the Commission.
وبالرغم من أن الفريق لم يبين تفصيلاً تقديره لكل عنصر مطالبة بعينه على حدة إلاّ أنه قام بما يلزم لكفالة أن يبين هذا التقرير بوضوح تلك اﻷجزاء من المطالبات التي رئي أنها لا تندرج في الولاية المنوطة باللجنة.

٣ - وفي الدورات السادسة والثلاثين إلى الخمسين، أعربت الجمعيـة العامـة مرة أخرى عن ارتياحها لعمل اللجنة، واعتمدت تقاريرها)٢( وتوصياتها، وأعادت تأكيد الولاية المنوطة باللجنة في القرارات ٣٤/١٨٢، و٣٦/١٤٩ باء و٣٧/٩٤ باء و٣٨/٨٢ باء و٣٩/٩٨ ألف و٤٠/١٦٤ ألف و٤١/٦٨ باء و٤٢/١٦٢ و٤٣/٦٠ و٤٤/٥٠ و٤٥/٧٦ و٤٦/٧٣ باء و٤٧/٧٣ باء و٤٨/٤٤ باء و٤٩/٣٨ باء و٥٠/٣١ باء.

As set forth in paragraphs 16-18 and 23 of the “Report and Recommendations Made by the Panel of Commissioners Concerning the First Instalment of ‘E3'Claims (S/AC.26/1998/13) (the “First Report”), the Panel determined that paragraph 16 of Security Council resolution 687 (1991) reaffirmed the liability of Iraq and defined the jurisdiction of the Commission.
9- وفقاً لما ورد في الفقرات 16-18 و23 من " التقرير والتوصيات المقدمة من فريق المفوضين بشأن الدفعة الأولى من المطالبات من الفئة " هاء/3 " (S/AC.26/1998/13) ( " التقرير الأول " )، قرر الفريق أن الفقرة 16 من قرار مجلس الأمن 687 (1991) تؤكد من جديد مسؤولية العراق وتحدد الولاية المنوطة باللجنة.

As set forth in paragraphs 16-18 and 23 of the “Report and Recommendations Made by the Panel of Commissioners Concerning the First Instalment of ‘E3’ Claims” (the “First ‘E3’ Report”) (S/AC.26/1998/13), the Panel determined that paragraph 16 of Security Council resolution 687 (1991) reaffirmed the liability of Iraq and defined the jurisdiction of the Commission.
١١- وحسبما ورد في الفقرات ٦١-٨١ و٣٢ من " تقرير وتوصيات مقدمة من فريق المفوضين بشأن الدفعة اﻷولى من المطالبات من الفئة هاء/٣ " ) " التقرير اﻷول عن الفئة هاء/٣ " ( (S/AC.26/1998/13)، انتهى الفريق الى أن الفقرة ٦١ من قرار مجلس اﻷمن ٧٨٦ )١٩٩١( تؤكد من جديد مسؤولية العراق وتحدد الولاية المنوطة باللجنة.

The Panel has defined the “arising prior to” clause in paragraph 16 of Security Council resolution 687 (1991) to limit the jurisdiction of the Commission to exclude debts of the Government of Iraq if the performance relating to that obligation took place prior to 2 May 1990.
١٤- وكان الفريق قد عرﱠف شرط " الناشئة قبل " الوارد في الفقرة ٦١ من قرار مجلس اﻷمن ٧٨٦ )١٩٩١( بغية تحديد الولاية المنوطة باللجنة وذلك لاستبعاد ديون حكومة العراق إذا كان انجاز العمل موضوع الالتزام بهذه الديون قد حدث قبل ٢ أيار/مايو ٠٩٩١.
