It is my opinion that the forced removal of the complainant would constitute a breach by the State party of article 3 of the Convention against Torture and Other Cruel, Inhuman or Degrading Treatment or Punishment, for the following reasons:
إن إعادة صاحبة الشكوى قسراً يشكل من وجهة نظري، انتهاكاً من الدولة الطرف للمادة 3 من اتفاقية مناهضة التعذيب وغيره من ضروب المعاملة أو العقوبة القاسية أو اللاإنسانية أو المهينة وذلك للأسباب التالية:

16. The Committee against Torture, acting under article 22, paragraph 7, of the Convention against Torture and Other Cruel, Inhuman or Degrading Treatment or Punishment, decides that the facts before it constitute breaches by the State party of articles 3 and 22 of the Convention.
16- وتقرر لجنة مناهضة التعذيب، عملاً بالفقرة 7 من المادة 22 من اتفاقية مناهضة التعذيب وغيره من ضروب المعاملة أو العقوبة القاسية أو اللاإنسانية أو المهينة، أن الوقائع المعروضة عليها تمثل انتهاكاً من الدولة الطرف للمادتين 3 و22 من الاتفاقية.

In the absence of any information from the State party, the Committee concluded that the facts as presented revealed a violation by the State party of article 14, paragraph 2, of the Covenant.
ونظراً لعدم تلقي تعليقات من الدولة الطرف، خلصت اللجنة إلى أن الوقائع المعروضة عليها تكشف انتهاكاً من الدولة الطرف للفقرة 2 من المادة 14 من العهد.

As the State party had not commented on the allegations, the Committee considered that the facts as submitted revealed a violation by the State party of the rights of Mr. Karimov, Mr. Askarov and the Davlatov brothers under article 10 of the Covenant.

3.1 The complainant claims that his forcible return to Sri Lanka would constitute a violation by the State party of article 3 of the Convention, since he would face a high risk of torture if he were deported to that country, as a young single male Tamil who had previously been arrested and tortured several times as a suspected LTTE activist.
3-1 يدعي صاحب الشكوى أن إعادته قسراً إلى سري لانكا تشكل انتهاكاً من الدولة الطرف للمادة 3 من الاتفاقية، نظراً لأنه سيتعرض لخطر التعذيب في حالة ترحيله إلى ذلك البلد، باعتباره شاباً عازباً من التاميل سبق إلقاء القبض عليه وتعذيبه عدة مرات للاشتباه في أنه من ناشطي حركة نمور تحرير تاميل إيلام.

The fact that the victim's arrest on 1 April 1997 by the Ben Aknoun military security forces has not been acknowledged, that his detention is not mentioned in the police custody registers and that there has been no real and effective investigation constitutes a violation by the State party of article 9.
وما دام جهاز الأمن العسكري في بن عكنون لم يعترف بتوقيف الضحية في 1 نيسان/أبريل 1997، ولم يُسجل احتجاز الضحية في سجلات السجون ولم يُجر بشأنه أي تحقيق فعال، فإن ذلك يشكل انتهاكاً من الدولة الطرف للمادة 9.

وما دام جهاز الأمن العسكري في بن عكنون لم يعترف بتوقيف الضحية في 1 نيسان/أبريل 1997 ، ولم يُسجل احتجاز الضحية في سجلات السجون ولم يُجر بشأنه أي تحقيق فعال، فإن ذلك يشكل انتهاكاً من الدولة الطرف للمادة 9.

4.2 Mr. Sa'di claims that the refusal of the Press Department of the Samarkand region to re-register the Oina newspaper (that he was buying and reading on a regular basis) amounts to a violation by the State party of his right to freedom of expression (in particular his right to receive information and ideas in print), as protected by article 19 of the Covenant.
4-2 ويدعي السيد سعدي أن رفض قسم الصحافة بإقليم سمرقند إعادة تسجيل صحيفة " أوينا " (التي كان يشتريها ويقرأها بصفة منتظمة) إنما يشكل انتهاكاً من الدولة الطرف لحقه في حرية التعبير (وبخاصة حقه في تلقي المعلومات والأفكار في شكل مطبوع)، الذي تحميه المادة 19 من العهد.

14. The Committee against Torture, acting under article 22, paragraph 7, of the Convention against Torture and Other Cruel, Inhuman or Degrading Treatment or Punishment, decides that the facts before it reveal a breach by the State party of articles 3 and 22 of the Convention.
14- وتقرر لجنة مناهضة التعذيب، عملاً بالفقرة 7 من المادة 22 من اتفاقية مناهضة التعذيب وغيره من ضروب المعاملة أو العقوبة القاسية أو اللاإنسانية أو المهينة، أن الوقائع المعروضة عليها تمثل انتهاكاً من الدولة الطرف للمادتين 3 و22 من الاتفاقية.

9. The Committee against Torture, acting under article 22, paragraph 7, of the Convention against Torture and Other Cruel, Inhuman or Degrading Treatment or Punishment, considers that the complainant has not substantiated his claim that he would be subjected to torture upon return to Bangladesh and therefore concludes that the complainant's removal to that country would not constitute a breach by the State party of article 3 of the Convention.
9- وعملاً بالفقرة 7 من المادة 22 من اتفاقية مناهضة التعذيب وغيره من ضروب المعاملة أو العقوبة القاسية أو اللاإنسانية أو المهينة، ترى اللجنة أن صاحب الشكوى لم يدعم ادعاءه بالأدلة التي تثبت أنه سيتعرض للتعذيب في حالة عودته إلى بنغلاديش، وتعتبر بالتالي أن ترحيل صاحب الشكوى إلى ذلك البلد لا يمثل انتهاكاً من الدولة الطرف للمادة 3 من الاتفاقية.
