76. His delegation supported the idea that the Statute should cover the most serious crimes of concern to the international community.
٧٦ ـ وأعرب عن مساندة وفده لفكرة أن النظام اﻷساسي ينبغي أن يشمل أشد الجرائم جسامة التي تؤرق المجتمع الدولي.

In his delegation's view, accession by a State to the Statute should automatically imply acceptance of the court's jurisdiction in respect of the crimes listed in article 20, without the need for any additional formal acceptance thereof.
ولذلك فإن وفد بلده يرى أن انضمام الدولة الى النظام اﻷساسي ينبغي أن يدل ضمنا بصورة آلية على القبول باختصاص المحكمة في النظر في الجرائم المدرجة في المادة ٢٠، دون الحاجة الى قبول رسمي إضافي بهذا الاختصاص.

At the same time, one representative observed that certain rules in the Statute should be more specific in order to safeguard the rights of the accused at the national level.
وفي الوقت ذاته، لاحظ أحد الممثلين أن بعض القواعد في النظام اﻷساسي ينبغي أن تكون أكثر تحديدا حتى تصون حقوق المتهم على الصعيد الوطني.

Since criminal prosecution is only envisaged in relation to persons, the Statute should make clear that the Security Council is in this case drawing attention to situations in the immediate context of which the crimes defined under article 22 might be involved.
وحيث أنه ليس من المتصور إجراء محاكمة جنائية إلا لﻷشخاص، فإن النظام اﻷساسي ينبغي أن يوضح أن مجلس اﻷمن، في هذه الحالة، يوجه الانتباه إلى الحالات التي قد ترتكب في سياقها المباشر الجرائم المحددة بموجب المادة ٢٢.

The States parties to the Statute should be able to refer specific cases for examination by the Court, as well as whole situations of the type considered by the Security Council.
فالدول اﻷطراف في النظام اﻷساسي ينبغي أن تكون قادرة على احالة قضايا معينة لكي تفحصها المحكمة ، وكذلك جميع الحالات من النوع الذي ينظر فيه مجلس اﻷمن .

His delegation also stressed that the adoption of the Statute should be the primary goal in 1998 and stated its willingness to display flexibility to achieve that goal.
وقال المتحدث إن وفده يشدد أيضا على أن اعتماد النظام اﻷساسي ينبغي أن يكون الهدف اﻷول في عام ١٩٩٨، وأعرب عن استعداده ﻹظهار المرونة من أجل تحقيق هذا الهدف.

4. Regarding the principle of complementarity, the draft Statute should stipulate that the international criminal court complemented national criminal justice and did not preclude the existing jurisdiction of national courts.
٤ ـ وتطرق إلى مبدأ التكامل، فقال إن مشروع النظام اﻷساسي ينبغي أن ينص على أن تكون المحكمة الجنائية الدولية مكملة لنظم العدالة الجنائية الوطنية ولا تحول دون قيام الاختصاص الحالي للمحاكم الوطنية.

57. His delegation felt that the Statute should provide for the possibility of supplementing the list of crimes that were subject to the court's jurisdiction, under appropriate conditions.
٥٧ ـ وذكر أن وفده يرى أن النظام اﻷساسي ينبغي أن ينص على إمكانية القيام في الظروف المناسبة باستكمال قائمة الجرائم التي تخضع لاختصاص المحكمة.

The draft Statute should strike a balance and clarify the relationship between international and national criminal jurisdictions.
وأكد أن مشروع النظام اﻷساسي ينبغي أن يحقق توازنا بين الاختصاص الجنائي الدولي والاختصاص الجنائي الوطني وأن يوضح العلاقة بينهما.

Several delegations expressed the view that the Statute should provide the legal basis for the obligation of States parties to provide the widest assistance to the Court and the general framework that would govern such matters.
٣٢٧ - كان من رأي بضعة وفود أن النظام اﻷساسي ينبغي أن يوفر اﻷساس القانوني لالتزام الدول اﻷطراف بتقديم المساعدة للمحكمة على أوسع نطاق وأن يوفر اﻹطار العام الذي يحكم هذه المسائل.

The view was also expressed that the Statute should include a provision that would prevent the court from imposing punishment on the basis of customary law without a clear definition of the crime being included in the statute.
وارتئي أيضا أن النظام اﻷساسي ينبغي أن يتضمن حكما يمنع المحكمة من فرض عقوبة بموجب قانون عرفي دون أن يكون هناك تعريف واضح للجريمة مدرج في النظام اﻷساسي.

It would seem therefore that, if the General Assembly established a perm anent criminal court, its Statute should contain a provision for the application of the draft Code.

57. In his delegation's view, the text of article 1 of the draft Statute should read " There is established an International Tribunal " .
٥٧ - ومضى يقول إن وفده يرى أن المادة اﻷولى من مشروع النظام اﻷساسي ينبغي أن تنص على ما يلي: " تنشأ محكمة دولية " .

The Statute should include a reference to the power of the Security Council to create ad hoc tribunals.
١٦ - واختتم قائلا ان النظام اﻷساسي ينبغي أن يتضمن اشارة الى سلطة مجلس اﻷمن لانشاء محاكم متخصصة .

With regard to article 104, her delegation considered that only States parties to the Statute should finance the expenditures of the Court.
١٤ - وفيما يتعلق بالمادة ٤٠١ ، قالت ان وفدها يرى أن الدول اﻷطراف وحدها في النظام اﻷساسي ينبغي أن تمول نفقات المحكمة .

On article 112, his delegation considered that the Statute should be opened for signature following the successful conclusion of the Conference, and favoured inclusion of article 113 for the reasons advanced by the Norwegian delegation.
وبخصوص المادة ٢١١ ، قال ان وفده يرى أن النظام اﻷساسي ينبغي أن يفتح باب التوقيع عليه عقب انتهاء المؤتمر بنجاح ، وهو يحبذ ادراج المادة ٣١١ لﻷسباب التي قدمها وفد النرويج .
