That was the sixth session devoted to the preparation of that uniform law, tentatively entitled the draft Convention on Assignment in Receivables Financing.

The Commission’s work on the draft Convention on Assignment in Receivables Financing was of particular importance for the developing countries, since clear and unambiguous rules would increase the availability of credit financing to such countries at more affordable rates.

The Working Group had previously adopted the title, the preamble and draft articles 1 to 24 of the draft Convention on Assignment in Receivables Financing, and his delegation hoped that work on the optional substantive law priority rules would be completed expeditiously so that the draft Convention could be submitted to the Commission for adoption in 2000.

IBA is participating as an observer in the work of UNCITRAL’s Working Group on International Contract Practices to develop a draft Convention establishing a uniform law on Assignment in Receivables Financing.
وتشارك النقابة بصفة مراقب في أعمال الفريق العامل المعني بممارسات العقود الدولية التابع للجنة اﻷمم المتحدة للقانون التجاري الدولي، وذلك من أجل وضع مشروع اتفاقية تقرر قانونا موحدا بشأن اﻹحالة في التمويل بالمستحقات.

46. He agreed with the representative of Hungary that the draft Convention on Assignment in Receivables Financing could minimize the competitive disadvantages experienced by parties from developing countries or countries with transitional economies.
٦٤ - وأعرب عن اتفاقه مع ممثل هنغاريا على أن مشروع اتفاقية اﻹحالة في التمويل بالمستحقات يمكن أن يقلل إلى أدنى حد المساوئ التنافسية التي تعانيها اﻷطراف المنتمية للبلدان النامية أو لبلدان تمر بمرحلة انتقالية.

54. The draft Convention on Assignment in Receivables Financing would lead to increased availability of credit at more affordable rates and would eliminate or limit the competitive disadvantages experienced in the developing countries and countries with transitional economies.
٤٥ - وأوضح أن مشروع اتفاقية اﻹحالة في التمويل بالمستحقات سيترتب عليه زيادة في إتاحة الائتمان بأسعار أكثر قبولا وسيزيل أو يقلل من اﻷوضاع التنافسية غير المواتية التي تعاني منها البلدان النامية والبلدان التي تمر اقتصاداتها بمرحلة انتقالية.

At its twenty-sixth session, the Working Group considered a note prepared by the Secretariat, which contained a revised version of the draft Convention on Assignment in Receivables Financing (A/CN.9/WG.II/WP.89).

٢٢٢ - تجدر اﻹشارة إلى أن اللجنة كانت قد نظرت في المشاكل القانونية القائمة في مجال اﻹحالة في دوراتها من السادسة والعشرين إلى الثامنة والعشرين )المعقودة في الفترة من عام ١٩٩٣ إلى عام ٥٩٩١()٥١(، وعهدت، في دورتها الثامنة والعشرين المعقودة في عام ١٩٩٥، إلى الفريق العامل المعني بالممارسات التعاقدية الدولية بمهمة إعداد قانون موحد بشأن اﻹحالة في التمويل بالمستحقات)٦١(.

Mr. Qu Wensheng (China) said that UNCITRAL had played an active role in harmonizing and promoting international trade law, as reflected in the Model Law on Cross-Border Insolvency, the Model Law on Electronic Commerce, the Convention on the Recognition and Enforcement of Foreign Arbitral Awards, the Convention on Contracts for the International Sale of Goods and the draft convention on Assignment in Receivables Financing.
