It has to be recalled that the Human Rights Committee, in its Communications 1321/2004 and 1322/2004, unequivocally stated the following:
ويتعين التذكير بأن اللجنة المعنية بحقوق الإنسان أعلنت بشكل لا لبس فيه، في بلاغيها 1321/2004 و1322/2004 ما يلي:

It should be borne in mind that the Human Rights Committee had concluded that different treatment did not in itself constitute discrimination if there were reasonable and objective grounds to justify it and if it responded to a legitimate objective in conformity with the Covenant.

24. Concerning the notion of arbitrary deprivation, it should be recalled that the Human Rights Committee has shed light on the meaning of the concept of " arbitrary " in the context of the International Covenant on Civil and Political Rights.
24- وفيما يتعلق بمفهوم الحرمان التعسفي، ينبغي التذكير بأن اللجنة المعنية بحقوق الإنسان سلطت الضوء على معنى مفهوم " التعسفي " في سياق العهد الدولي الخاص بالحقوق المدنية والسياسية.

It is also important to emphasize that the Human Rights Committee has stated that " the right to be tried by an independent and impartial tribunal is an absolute right that may suffer no exception " .
ومن المهم أيضاً التنويه بأن اللجنة المعنية بحقوق الإنسان قد ذكّرت بأن " حق الشخص في أن تقوم محكمة مستقلة ومحايدة بمحاكمته هو حق مطلق ولا يسمح بأي استثناء منه " (25).

It is also important to emphasize that the Human Rights Committee has stated that " the right to be tried by an independent and impartial tribunal is an absolute right that may suffer no exception " .
ومن المهم أيضاً التنويه بأن اللجنة المعنية بحقوق الإنسان قد ذكَّرت بأن " حق الشخص في أن تقوم محكمة مستقلة ومحايدة بمحاكمته هو حق مطلق ولا يسمح بأي استثناء منه " ().

The source recalls that the Human Rights Committee has affirmed that " [t]he right to communicate with counsel requires that the accused is granted prompt access to counsel. "
62- ويذكّر المصدر بأن اللجنة المعنية بحقوق الإنسان أكدت أن الحق في الاتصال بمحامٍ يقتضي منح المتهم فرصة توكيل محام على وجه السرعة().

14. It was recalled that the Human Rights Committee, in its general comment No. 29, indicated that the International Covenant on Civil and Political Rights applied also in situations of armed conflict to which the rules of international humanitarian law were applicable.
14- وتم التذكير بأن اللجنة المعنية بحقوق الإنسان أشارت، في تعليقها العام رقم 29، إلى أن العهد الدولي الخاص بالحقوق المدنية والسياسية ينطبق أيضاً في حالات الصراع المسلح التي تنطبق عليها قواعد القانون الإنساني الدولي.

17. The source recalls that the Human Rights Committee, in its concluding observations of 3 November 2004, expressed concern about the fact that the independence of the judiciary was not fully guaranteed and specifically recommended that Morocco take the necessary steps to guarantee its independence and impartiality (CCPR/CO/82/MAR, para. 19).
17- ويُذكّر المصدر بأن اللجنة المعنية بحقوق الإنسان أعربت، في ملاحظاتها الختامية الصادرة في 3 تشرين الثاني/نوفمبر 2004، عن قلقها لأن استقلال القضاء غير مكفول بالكامل وأوصت المغرب صراحة بأن يتخذ التدابير اللازمة لضمان استقلال القضاء وحياده (الوثيقة CCPR/CO/82/MAR، الفقرة 19).

They note that the Human Rights Committee, when dealing with particularly serious violations, has held that only domestic remedies in criminal justice can be deemed to constitute effective remedies within the meaning of article 2, paragraph 3, of the Covenant.
