Mr. Nakhari (Syrian Arab Republic) said that the adoption of the draft resolution demonstrated once again that the international community's repudiation of the inhumane practices of the Israelis, sent a clear message to Israel that it must abide by the Fourth Geneva Convention and abstain from exploiting the resources of the occupied territories, and confirmed that the occupation of those territories was illegal.
13 - السيد عبد المولى النقري (الجمهورية العربية السورية): قال إن اعتماد مشروع القرار يبين مرة أخرى رفض المجتمع الدولي لممارسات إسرائيل اللاإنسانية، ويبعث برسالة واضحة إلى إسرائيل لكي تلتزم باتفاقية جنيف الرابعة وتمتنع عن استغلال موارد الأراضي المحتلة، ويؤكد أن احتلال هذه الأراضي غير مشروع.

The excuse that no investigations are required on account of the characterization of the conflict as armed conflict is not convincing and shows a disregard for the provision of the Fourth Geneva Convention which requires the occupying Power to prosecute those guilty of committing grave breaches and other infractions of the Convention (art. 146).

The recommendation was to be followed up by a meeting of experts to discuss matters of a procedural and logistical nature giving due regard to the actual situation in the occupied territories relative to the Fourth Geneva Convention, as well as the legal and political implications of the conference, keeping in mind the obligations of Israel and other States parties under this Convention.

She also asked whether there was a need for a new Advisory Opinion of the International Court of Justice on the legal consequences of prolonged occupation and what steps the international community should take to improve the worrying situation of Palestinian prisoners in Israel and to ensure that Israel, the occupying Power, respected the Fourth Geneva Convention.
وثانيا، سألته عما إذا كان من الضروري طلب فتوى جديدة من محكمة العدل الدولية بشأن الآثار القانونية المترتبة على استمرار الاحتلال؛ وثالثا، أعربت له عن رغبتها في معرفة رأي المقرر الخاص بشأن الأسلوب الذي من المقرر أن يتبعه المجتمع الدولي بهدف تحسين هذه الحالة، وحمل إسرائيل، باعتبارها الدولة القائمة بالاحتلال، على الالتزام باتفاقية جنيف الرابعة.

28. On 7 June 1982, Palestine presented a unilateral written undertaking to Switzerland, the depositary of the Geneva Conventions, to be bound by the Fourth Geneva Convention and other international instruments. Switzerland accepted that undertaking without implying that it represented an instrument of ratification.
28 - وكانت فلسطين قد قدمت تعهدا خطيا من جانب واحد بتاريخ 7 حزيران/يونيه 1982 إلى سويسرا بوصفها الدولة المودعة لاتفاقيات جنيف تعلن فيه التزامها باتفاقية جنيف الرابعة وصكوك دولية أخرى، وردت سويسرا بقبول التعهد دون أن يعني ذلك أنه " صك انضمام " .

In addition, the decisions of the Israeli Court are a grave breach of the Fourth Geneva Convention which states in articles 146 and 147 that Contracting Parties shall “enact any legislation necessary to provide elective penal sanctions for persons committing or ordering to be committed, any of the grave breaches of the present Convention” which includes, “wilful killing, torture or inhuman treatment”.
وبالاضافة الى ذلك، فإن أحكام المحكمة الاسرائيلية تشكل اخلالا جسيما باتفاقية جنيف الرابعة التي تنص في المادتين ٦٤١ و٧٤١ على وجوب قيام اﻷطراف المتعاقدة بسن " أية تشريعات لازمة لفرض عقوبات جزائية فعالة على اﻷشخاص الذين يقترفون أو يأمرون باقتراف احدى المخالفات الجسيمة لهذه الاتفاقية " والتي تشمل " القتل العمد والتعذيب أو المعاملة اللاانسانية " .
