8.2 With regard to the author's claim that his rights under article 9 have been violated, the Committee notes that his detention was lawful under Dutch law, section 26 of the Aliens Act.

5.4 As regards the author's claim that the imposition of the death sentence was disproportionate since no one was killed or wounded during the robbery, the State party submits that the author's conviction was in accordance with Zambian law.

5.6 With regard to the author's claim that he was tortured by the police in order to force him to give a statement, the State party submits that torture is prohibited under Zambian law.
٥-٦ وفيما يتعلق بادعاء صاحب البلاغ بأن الشرطة قامت بتعذيبه من أجل إكراهه على اﻹدلاء بأقوال، أفادت الدولة الطرف أن التعذيب محظور بموجب قانون زامبيا.

8.6 As regards the author's claim that he should not have been convicted on the basis of the evidence against him, the State party submits that that is a matter for the court of first instance to decide.
٨-٦ وفيما يتعلق بادعاء صاحب البلاغ بأن اﻷدلة الموجهة ضده لا تدينه، تدفع الدولة الطرف بأن هذه مسألة تقررها المحكمة الابتدائية.

4.4 With regard to the author's claim that the Supreme Court several times postponed hearings of his writ of mandamus, the State party maintains that the procedure of hearings at the Supreme Court is regulated by its regulation2049 BS.
4-4 وفيما يتعلق بادعاء صاحب البلاغ بأن المحكمة العليا أجلت لعدة مرات جلسات النظر في طلبه بإصدار أمر امتثال، تؤكد الدولة الطرف أن إجراءات عقد الجلسات في المحكمة العليا تنظمها لائحة المحكمة 2049 BS.

" 7.2 The Committee has noted the author's claim that his detention under the CSSOA imposes double punishment without further determination of criminal guilt and that the court failed to include any order for preventive reasons in the initial sentence.

7.9 The Committee notes the author's claim that his trial was unfair, as the court was biased and did not comply with the requirements of the law of criminal procedure.

7.2 The Committee has noted the author's claim that the application of the Law on Mass Events has breached his rights under articles 19, paragraph 2, and 21 of the Covenant.
7-2 وأخذت اللجنة علماً بادعاء صاحب البلاغ بأن تطبيق قانون التجمعات الجماهيرية قد انتهك حقوقه بموجب الفقرة 2 من المادة 19 والمادة 21 من العهد.

4.2 With regard to the author's allegation that his detention under the DPSOA was arbitrary, the State party submits that his detention was lawful, reasonable and necessary in all circumstances.
4-2 وفيما يتعلق بادعاء صاحب البلاغ بأن احتجازه كان بموجب قانون السجناء الخطرين، تؤكد الدولة الطرف أن احتجازه كان قانونياً ومعقولاً وضرورياً في جميع الظروف.

9.7 As regards the author's allegation that the quality of the interpretation was poor and that this prejudiced him in his defence, the Committee notes that the trial transcript shows that the judge regularly intervened in the hearing of witnesses in order to facilitate the work of the interpreter.
٩-٧ وفيما يتعلق بادعاء صاحب البلاغ بأن نوعية الترجمة الشفوية كانت سيئة وأن هذا عرﱠضه للخطر في دفاعه، تلاحظ اللجنة أن سجل المحاكمة يبين أن القاضي تدخل بانتظام عند سماع الشهود من أجل تسهيل عمل المترجمة.

6.2 The Committee notes the claim of the author that his brother, Abdelmotaleb Abushaala, was arrested on 17 September 1995 in the car park of the Higher Institute of Civil Aviation by armed officers in plain clothes from the internal security forces.
6-2 تحيط اللجنة علماً بادعاء صاحب البلاغ بأن أخاه، عبد المطلب أبو شعالة، اعتُقل في 17 أيلول/سبتمبر 1995 في مرآب المعهد العالي للطيران المدني من قبل أفراد مسلحين في زي مدني تابعين لمصالح الأمن الداخلي.

As for the author's contention that his case reveals a violation of article 15 of the Covenant, the Committee notes that the sentence was based on the legislation in force at the time of the acts, and not on the legislation subsequently enacted.
