This report presents the guiding principles on foreign debt and human rights for consideration by the Human Rights Council.

5. In June 2010, the Independent Expert participated in the Latin American Regional Consultation on the draft general guidelines on foreign debt and human rights.

In its resolution 20/10, the Council requested the Independent Expert to submit to the Council an analytical report on the implementation of that resolution and on the process of developing the commentary to the guiding principles on foreign debt and human rights to the Council in 2013.

53. In its resolution 23/11, the Council requested the Independent Expert to submit a report on the implementation of that resolution, and containing the commentary to the guiding principles on foreign debt and human rights, to the Council at its twenty-fifth session.

To this end, he has consulted a broad range of stakeholders on a number of issues relating to his mandate, including notably in the process of elaborating the guiding principles on foreign debt and human rights which were endorsed by the Council in June 2012.

5. After a comprehensive consultative process with States, academic experts and civil society representatives, the previous mandate holder, Cephas Lumina, presented the Guiding Principles on foreign debt and human rights (A/HRC/20/23, annex) to the Human Rights Council in June 2012.

In line with the views that emerged from the regional consultations and in keeping with the standards developed by other special procedures mandate holders, the Independent Expert has proposed that the guidelines be renamed " guiding principles on foreign debt and human rights. "
15- تمشياً مع الآراء التي انبثقت عنها المشاورات الإقليمية ومراعاة للمعايير التي وضعها أصحاب ولايات أخرى في إطار الإجراءات الخاصة، اقترح الخبير المستقل إعادة تسمية المبادئ التوجيهية لتصبح " المبادئ التوجيهية المتعلقة بالديون الخارجية وحقوق الإنسان " .

In this regard, the Independent Expert urges all States to fully adhere to the Guiding Principles on foreign debt and human rights adopted by the Human Rights Council in June 2012 (A/HRC/20/23, annex), and to support the adoption of the UNCTAD Consolidated Principles on Promoting Responsible Sovereign Lending and Borrowing.

Between 24 July and 5 August 2011, the independent expert on foreign debt and human rights conducted a mission in the Democratic Republic of the Congo, with a particular view to assessing the impact of the country's debt burden on economic, social and cultural rights.

Between June 2010 and February 2011, the Office of the United Nations High Commissioner for Human Rights (OHCHR) convened three regional multi-stakeholder consultations - in Latin America and the Caribbean, Africa, and Asia and the Pacific - on the draft general guidelines on foreign debt and human rights ( " the guidelines " ) to assist the Independent Expert in refining and elaborating the guidelines.

Given the wide range of human rights positively and negatively affected by debt and the complexities posed by the links between debt and human rights, the study of each topic presented in the workplan will include a reflection on the specific human rights principles and norms implicated by those links, paying special attention to the Guiding Principles on foreign debt and human rights (A/HRC/20/23, annex).
