IV. Measures taken with respect to those responsible for the overpayment

14. With regard to the measures to be taken in connection with those responsible for the overpayment, the Advisory Committee notes from paragraph 18 of the report that a formal inquiry has been instituted in order to establish the circumstances of the overpayment and that any measures taken would be based on the conclusions of the inquiry.

In its resolution 51/234 of 13 June 1997, the General Assembly requested the Secretary-General to continue his efforts to recover the overpayment of mission subsistence allowance and to report to it at its fifty-second session on the results of action taken for its recovery, including measures taken with respect to those responsible for the overpayment.

The Committee, however, regrets that the report providing updated information on developments relating to the issue of overpayment of mission subsistence allowance and compensatory time off, including measures taken with respect to those responsible for the overpayment on the basis of the conclusion of the inquiry, as requested in paragraph 18 of Assembly resolution 53/238, is not available.

Piracy is a crime of universal jurisdiction, meaning that any State may seize a pirate ship on the high seas or in the exclusive economic zone of any other State, arrest the persons on board and prosecute them. This has permitted States with naval forces in the area to actively engage in bringing those responsible for acts of piracy to justice.
