As to the claim that his expulsion in addition would violate articles 2 and 16, the State party notes that article 2 requires a State party to take effective measures to prevent acts of torture, and that an expulsion cannot be considered an act which intentionally causes pain or suffering of such severity so as to bring it within the definition of torture contained in article 1, for one of the purposes enumerated there.
أما في ما يتعلق بما يدعيه من أن طرده سيشكل أيضا انتهاكا للمادتين 2 و16، فتلاحظ الدولة الطرف أن المادة 2 تقتضي من الدول الأطراف اتخاذ تدابير فعالة لمنع أعمال التعذيب، وأنه لا يمكن اعتبار الطرد عملا يتسبب عمدا في ألم أو عذاب يبلغ من الحدة ما يجعله مشمولا بتعريف التعذيب الوارد في المادة 1، في ما يخص أحد الأغراض المبينة في تلك المادة.
