In this regard, the Special Rapporteur recalls article 12 of the Convention on the Rights of Child, which provides that States Parties shall assure to the child who is capable of forming his or her own views the right to express those views freely in all matters affecting the child, the views of the child being given due weight in accordance with the age and maturity of the child.
وتذكِّر المقررة الخاصة، في هذا الصدد، بالمادة 12 من اتفاقية حقوق الطفل التي تنص على أن تكفل الدول الأطراف في الاتفاقية للطفل القادر على تكوين آرائه الخاصة حق التعبير عن تلك الآراء بحرية في جميع المسائل التي تمس الطفل، وتولي آراء الطفل الاعتبار الواجب وفقاً لسن الطفل ونضجه.

" 24. Recognizes that the child who is capable of forming his or her own views should be assured the right to express those views freely in all matters affecting the child, the views of the child being given due weight in accordance with his or her age and maturity;
" 24 - تقر بلزوم أن يكفل للطفل القادر على تكوين آرائه الخاصة الحق في التعبير عن تلك الآراء بحرية في جميع المسائل التي تمس الطفل، بأن تعطى آراء الطفل ما تستحقه من الاهتمام الواجب حسب عمره ومدى نضجه؛

However, article 12 expressly articulates States Parties' obligations to " assure to the child who is capable of forming his or her own views the right to express those views freely in all matters affecting the child, the views of the child being given due weight in accordance with the age and maturity of the child " .
غير أن المادة 12 تنص صراحة على أن ' ' تكفل الدول الأطراف في الاتفاقية للطفل القادر على تكوين آرائه الخاصة حق التعبير عن تلك الآراء بحرية في جميع المسائل التي تمس الطفل، وتولي آراء الطفل الاعتبار الواجب وفقا لسن الطفل ونضجه``.

Article 12 recognizes the rights of children and young people to express those views freely in all matters affecting the child, the views of the child being given due weight in accordance with the age and maturity of the child.
فالمادة 12 تعترف بحق الأطفال والشباب في " التعبير عن تلك الآراء بحرية في جميع المسائل التي تمس الطفل، وتولي آراء الطفل الاعتبار الواجب وفقا لسن الطفل ونضجه " ، كما تعترف المادة 13 بالحق في حرية التعبير.

12. The right of the child to express his/her views freely in all matters affecting the child should be fully respected and implemented throughout every stage of the process of juvenile justice (see paragraphs 43-45 below).
12- ينبغي الاحترام الكامل لحق الطفل في الإعراب عن آرائه بحرية في جميع المسائل التي تمس الطفل وإعمالُ هذا الحق في كل مرحلة من مراحل عملية قضاء الأحداث (انظر الفقرات من 43 إلى 45 أدناه).
