• Protection of All Persons under Any

The State party should adopt legislation on the prison system in conformity with international human rights norms such as the Standard Minimum Rules for the Treatment of Prisoners and the Body of Principles for the Protection of All Persons under Any Form of Detention or Imprisonment.
يجب على الدولة الطرف أن تعتمد نصاً تشريعياً بشأن نظام السجون يكون متماشياً مع القواعد الدولية لحقوق الإنسان، مثل مجموعة المبادئ المتعلقة بحماية جميع الأشخاص الذي يتعرضون لأي شكل من أشكال الاحتجاز أو السجن.

(d) Adopt regulations requiring mandatory use of registers in all police premises in conformity with the relevant international agreements, particularly the Body of Principles for the Protection of All Persons under Any Form of Detention or Imprisonment.
(د) اعتماد لوائح تقتضي استخدام السجلات في جميع مرافق الشرطة بما يتوافق مع الاتفاقات الدولية ذات الصلة، وخصوصاً مع مجموعة المبادئ المتعلقة بحماية جميع الأشخاص الذي يتعرضون لأي شكل من أشكال الاحتجاز أو السجن.

The State party should take appropriate measures to ensure that its pretrial detention policy is appropriate to the unconvicted status of persons in detention, meets international standards, inter alia, the Body of Principles for the Protection of All Persons under Any Form of Detention or Imprisonment, and that such detention is used as an exceptional measure for a limited period of time.
ينبغي للدولة الطرف أن تتخذ التدابير المناسبة لضمان تَناسُب سياسة الاحتجاز السابق للمحاكمة مع وضع الأشخاص المحتجزين بصفتهم غير مدانين، ولضمان تلبيتها للمعايير الدولية ومن جملتها مجموعة المبادئ المتعلقة بحماية جميع الأشخاص الذي يتعرضون لأي شكل من أشكال الاحتجاز أو السجن، وعدم اللجوء إلى هذا النوع من الاحتجاز إلاّ كتدبير استثنائي ولفترة محدودة من الزمن.

The source submits that this is contrary to article 14 (b) and (d) of the ICCPR and principle 18, paragraph 1, of the Body of Principles for the Protection of All Persons under Any Form of Detention or Imprisonment.
ويدفع المصدر بأن ذلك يتعارض مع المادة 14(ب) و(د) من العهد الدولي الخاص بالحقوق المدنية والسياسية والفقرة 1 من المبدأ 18 من مجموعة المبادئ المتعلقة بحماية جميع الأشخاص الذي يتعرضون لأي شكل من أشكال الاحتجاز أو السجن.

32. In the light of the foregoing, the source expressed concern that the continued detention of Messrs. Soukyeh, Obeid, Al-Auyoui, Al-Bitar, Al-Kawasmi and Nayroukh may not be in conformity with, inter alia, articles 9 and 10 of the Universal Declaration of Human Rights and principles 1, 10, 11, and 32 of the Body of Principles for the Protection of All Persons under Any Form of Detention or Imprisonment.
32- وفي ضوء ما تقدم، أعرب المصدر عن قلقه لأن استمرار احتجاز السادة سوقية وعبيد والعويوي والبيطار والقواسمي ونيروخ ينتهك، في جملة أمور، المادتين 9 و10 من الإعلان العالمي لحقوق الإنسان، والمبادئ 1 و10 و11 و32 من مجموعة المبادئ المتعلقة بحماية جميع الأشخاص الذي يتعرضون لأي شكل من أشكال الاحتجاز أو السجن.

This right of Mr. Kaboudvand was violated as he was not allowed adequate access to meet and confer with his lawyer amounting to violations of article 14 (b) and (d) of the ICCPR and principle 18, paragraph 1, of the Body of Principles for the Protection of All Persons under Any Form of Detention or Imprisonment.
وعليه، فقد انتُهك حق السيد كابودفند، حيث لم يتمكن من الاتصال بمحاميه ومقابلته والتشاور معه بالشكل المناسب، وهو ما يعتبر بمثابة انتهاك للفقرتين (ب) و(د) من المادة 14 من العهد الدولي الخاص بالحقوق المدنية والسياسية والفقرة 1 من المبدأ 18 من مجموعة المبادئ المتعلقة بحماية جميع الأشخاص الذي يتعرضون لأي شكل من أشكال الاحتجاز أو السجن.
