One of the fundamentals of the right to due process for everyone charged with a criminal offence is to “examine, or have examined, the witnesses against him and to obtain the attendance and examination of witnesses on his behalf under the same conditions as witnesses against him”. (Covenant on Civil and Political Rights, art. 14,3 (e)).
إن أحد العناصر اﻷساسية للحق في إجراءات مناسبة ﻷي شخص يتهم بجريمة هو حقه في " أن يناقش شهود الاتهام، بنفسه أو من قبل غيره، وأن يحصل على الموافقة على استدعاء شهود النفي بذات الشروط المطبقة في حالة شهود الاتهام " )المادة ٤١، ٣)ﻫ( من العهد الدولي الخاص بالحقوق المدنية والسياسية(.

12. Subparagraph 3 (e) states that the accused shall be entitled to examine or have examined the witnesses against him and to obtain the attendance and examination of witnesses on his behalf under the same conditions as witnesses against him.
٢١- وتنص الفقرة الفرعية ٣)ﻫ( على انه يحق للمتهم أن يناقش شهود الاتهام بنفسه أو من قبل غيره، وأن يحصل على الموافقة على استدعاء شهود النفي واستجوابهم بذات الشروط المطبقة في حالة شهود الاتهام.

" (e) To examine, or have examined, the witnesses against him and to obtain the attendance and examination of witnesses on his behalf under the same conditions as witnesses against him;

(e) Accused persons have the right to examine the witnesses against them and to obtain the attendance and examination of witnesses on their behalf under the same conditions as witnesses against them.
(هـ) حق المتهمين في مناقشة شهود الاتهام والحصول على الموافقة على استدعاء شهود النفي بذات الشروط المطبقة في حالة شهود الاتهام.

This situation allegedly amounted to a violation of the authors' rights under article 14, paragraph 3(e), to obtain witnesses under the same conditions as witnesses against them.

3.2 The author further alleges a violation of article 14, paragraph 3 (e), in that he had insufficient opportunity to examine, or have examined, the witnesses against him at trial, and to obtain the attendance and examination of witnesses on his behalf under the same conditions as witnesses against him.
3-2 ويدعي صاحب البلاغ أيضاً حدوث انتهاك للفقرة 3(ﻫ) من المادة 14، لأنه لم تتح لـه فرصة كافية لأن يناقش شهود الاتهام بنفسه أو من قبل غيره، ولأن يحصل على الموافقة على استدعاء شهود النفي واستجوابهم بذات الشروط المطبقة على شهود الاتهام.

102. Section 12 (2) (e) of the Constitution states that every person who is charged with a criminal offence shall be afforded facilities to examine in person or by his legal representative the witnesses called by the prosecution before the court and to obtain the attendance and carry out the examination of witnesses to testify on his behalf before the court on the same conditions as those applying to witnesses called by the prosecution.
