Requests the Office of the United Nations High Commissioner for Human Rights to circulate the draft principles on housing and property restitution for refugees and displaced persons widely among non-governmental organizations, Governments, specialized agencies and other interested parties for comment;

The present report provides the first foray into such a task, and includes the " Draft Principles on housing and property restitution for Refugees and Displaced Persons " , for consideration by the Sub-Commission.

11. Another important development was the formulation of the Principles on housing and property restitution for Refugees and Displaced Persons, generally known as the " Pinheiro Principles " .

Recalling the Global Housing Strategy of the United Nations Human Settlements Programme, the principles on housing and property restitution for refugees and displaced persons and the Voluntary Guidelines on the Responsible Governance of Tenure of Land, Fisheries and Forests in the Context of National Food Security,

Moreover, the Guiding Principles on Internal Displacement and the Principles on housing and property restitution for Refugees and Displaced Persons offer guidance on measures to be taken to comply with the rights of displaced persons and refugees to the restitution of their housing, property and land.

To address these issues, Sub-Commission on the Promotion and Protection of Human Rights Special Rapporteur on housing and property restitution in the context of the return of refugees and internally displaced persons, Paulo Sérgio Pinheiro, proposed a set of draft principles on housing and property restitution for refugees and displaced persons in his 2004 interim report (E/CN.4/Sub.2/2004/22).

1.1 The Principles on housing and property restitution for refugees and displaced persons articulated herein are designed to assist all relevant actors, national and international, in addressing the legal and technical issues surrounding housing, land and property restitution in situations where displacement has led to persons being arbitrarily or unlawfully deprived of their former homes, lands, properties or places of habitual residence.

In its resolution 2004/2, the Sub-Commission welcomed the progress report of the Special Rapporteur, Mr. Paulo Sérgio Pinheiro (E/CN.4/Sub.2/2004/22), which contained the draft principles on housing and property restitution for refugees and displaced persons, as well as the draft commentary to the draft principles (E/CN.4/Sub.2/2004/22/Add.1).
60- وقد رحبّت اللجنة الفرعية، في قرارها 2004/2، بالتقرير المرحلي للمقرر الخاص، السيد باولو سيرجيو بينهيرو (E/CN.4/Sub.2./2004/22) الذي تضمن مشاريع المبادئ المتعلقة برد المساكن والممتلكات إلى اللاجئين والمشردين، فضلا عن مشروع التعليق على مشاريع المبادئ (E/CN.4/Sub.2./2004/22/Add.1).

3. In order to provide guidance with regard to international standard setting in this area, the present report includes a set of " Draft Principles on housing and property restitution for Refugees and Displaced Persons " (hereinafter " Draft Principles " ).

21. The Special Rapporteur welcomes the work of the Special Rapporteur of the SubCommission on housing and property restitution in the context of the return of refugees and internally displaced persons, Mr. Paulo Sergio Pinheiro, and particularly his work on the Principles on housing and property restitution for refugees and internally displaced persons (E/CN.4/Sub.2/2005/17).

23.1 The Principles on housing and property restitution for refugees and displaced persons shall not be interpreted as limiting, altering or otherwise prejudicing the rights recognized under international human rights, refugee and humanitarian law and related standards, or rights consistent with these laws and standards as recognized under national law.
23-1 لا تفسَّر المبادئ المتعلقة برد المساكن والممتلكات إلى اللاجئين والمشردين على أنها تَحُد من الحقوق المعترف بها في إطار قانون حقوق الإنسان الدولي وقانون اللاجئين الدولي والقانون الإنساني الدولي والمعايير ذات الصلة، أو تعدلها أو تخل بها على أي نحو آخر، أو بالحقوق المتوافقة مع تلك القوانين والمعايير المعترف بها بمقتضى القانون الوطني.

Meanwhile, the occupying Power not only denied the refugees the right to return; it also exploited their property by offering it for sale to foreigners, in violation of the United Nations principles on housing and property restitution for refugees and displaced persons ( " Pinheiro principles " ), with the ultimate goal of permanently depriving the lawful owners of their property rights and achieving ethnic cleansing.
