1.1 The author of the communication is Vasily Yuzepchuk, a Belarus national born in 1975, who at the time of the submission of the communication was detained on death row in Minsk, after being sentenced to death by the Brest Regional Court on 29 June 2009.

On 21 August 2003, the acting Chairperson of the Brest Regional Court revoked the decision of the Moskovsky District Court of Brest, because of the misspelling of the author's family name in the decision, and ordered a new hearing of the case by the same court of first instance but by a different judge.
