The most important source of law in that area was the draft Code of Crimes against the Peace and Security of Mankind elaborated by the Commission and the Statute of the International Criminal Court, to which Uruguay was a party.
وذكر أن أهم مصدر قانوني في هذا الصدد هو مشروع قانون الجرائم المخلة بسلم البشرية وأمنها الذي وضعته اللجنة، والنظام الأساسي للمحكمة الجنائية الدولية الذي تمثل أوروغواي أحد أطرافه.

Such criteria should be reflected in the Code and should include the extreme seriousness of the crimes and the general agreement of the international community regarding their character as a crime against the Peace and Security of Mankind.
كما دعا إلى تجسيد هذه المعايير في المدونة، وإلى جعلها تشمل الخطورة الشديدة للجرائم، واتفاق المجتمع الدولي العام على طابعها كجرائم مخلة بسلم البشرية وأمنها.

There should be consistency between the criteria used to determine such crimes in the draft statute of an international criminal court and those used in the draft Code of Crimes against the Peace and Security of Mankind.
وقال إنه ينبغي أيضا تأمين الاتساق بين المعايير المستخدمة في تعريف هذه الجرائم في مشروع النظام اﻷساسي للمحكمة الجنائية الدولية، والمعايير المستخدمة في مشروع مدونة الجرائم المخلة بسلم البشرية وأمنها.

The same considerations applied to the international tribunals established with respect to the former Yugoslavia and Rwanda, and to the draft Code of Crimes against the Peace and Security of Mankind and the draft statute for an international criminal court.
وهذه الاعتبارات تنطبق أيضا على المحكمتين الدوليتين اللتين أنشئتا فيما يتعلق بيوغوسلافيا السابقة ورواندا، وعلى مشروع مدونة الجرائم المخلة بسلم البشرية وأمنها ومشروع النظام اﻷساسي لمحكمة جنائية دولية.

The provisions of these documents are reflected in the Act of the Republic of Tajikistan on Defence and in the Criminal Code of the Republic of Tajikistan, section XV, " Crimes against the peace and security of humanity " .
وتنعكس أحكام هذه الصكوك في قانون جمهورية طاجيكستان المتعلق بالدفاع وفي المادة الخامسة عشرة من القانون الجنائي لجمهورية طاجيكستان المعنونة " الجرائم المخلة بسلم البشرية وأمنها " .

19. In order to achieve its aims of preventing and punishing crimes against the Peace and Security of Mankind, the Code should be binding.
١٩ - وقالت إن المدونة يجب أن تكون ملزمة لكي تحقق أهدافها وهي منع الجرائم المخلة بسلم البشرية وأمنها ومعاقبة مرتكبيها.

In this context, mention has also been made of the draft Code of Crimes against the Peace and Security of Mankind.

His delegation was of the view that a permanent international criminal court could offer fuller guarantees of objective, impartial and uniform application of the code of crimes against the Peace and Security of Mankind than would ephemeral, ad hoc jurisdictions.
وقال إن وفده يرى أن وجود محكمة جنائية دولية دائمة قد يوفر ضمانات لتطبيق قانون الجرائم المخلة بسلم البشرية وأمنها تطبيقا موضوعيا نزيها ومتسقا، أكمل من الضمانات التي توفرها الولايات القضائية المخصصة السريعة الزوال.

It was decided to keep the subject on the agenda of next year's meeting in the light of the expected study on the subject by the Sub-Commission and in the light of the work of the International Law Commission on the draft code of offences against the Peace and Security of Mankind.
وتقرر الابقاء على هذا الموضوع في جدول أعمال اجتماع العام المقبل للنظر فيه على ضوء الدراسة التي يُتوقع أن تجريها اللجنة الفرعية بشأن هذا الموضوع وأعمال لجنة القانون الدولي بشأن مشروع مدونة الجرائم المخلة بسلم البشرية وأمنها.

24. The Commission should continue to seek broad agreement on objective criteria for defining not only serious international crimes, but also those which qualified as crimes against the Peace and Security of Mankind.
٢٤ - ودعا اللجنة إلى أن تستمر في التماس اتفاق عريض على معايير موضوعية، ليس فقط لتعريف الجرائم الدولية الخطيرة، وإنما أيضا لتعريف الجرائم التي تصنف بأنها مخلة بسلم البشرية وأمنها.

Thus, it was suggested that the creation of a single international criminal court would better serve the rule of law by offering fuller guarantees of the objective, impartial and uniform application of the future Code of Crimes against the Peace and Security of Mankind than would ephemeral, ad hoc jurisdictions.
ولذلك فقد ألمح الى أن إنشاء محكمة جنائية دولية وحيدة ربما يكون هو السبيل اﻷفضل لضمان سيادة القانون بإعتبار أن إنشاء هذه المحكمة سيوفر ضمانات لتطبيق القانون المقبل الخاص بالجرائم المخلة بسلم البشرية وأمنها تطبيقا موضوعيا ونزيها ومتسقا ستكون أكمل من الضمانات التي توفرها الاختصاصات القضائية التي تنشأ بصورة عارضة ويكون لها طابع الزوال.

This interpretation of article 5, paragraph 2, of the 1984 Convention is an official interpretation of the Convention and, moreover, is consistent with the International Law Commission's statement in its draft Code of Crimes against the Peace and Security of Mankind concerning the suppression of such crimes;

وعرض على اللجنة كذلك مشروع قانون الجرائم المخلة بسلم البشرية وأمنها )A/CN.4/L.532( الذي اعتمدته لجنة القانون الدولي في دورتها الثامنة واﻷربعين)٤(؛ وإعلان مبادئ العدل اﻷساسية المتعلقة بضحايا اﻹجرام والتعسف في استعمال السلطة)٥( والمبادئ التي تكفل مراعاة حقوق ومصالح ضحايا مرافعات المحكمة الجنائية الدولية المقترحة)٦(.
