Still, as a matter of practice, as a rule, victims are not prosecuted for those crimes.

However, as was stated in paragraph 100 of the second report, the Special Rapporteur is of the opinion that for the purposes of elaboration of the provision dealing with the scope of application of the draft articles on the obligation aut dedere aut judicare, it does not seem to be essential to include any direct remark concerning those crimes or offences in the actual text of draft article 1.

Our overarching concern is to avoid impunity for those crimes.

The authors further argue that the ongoing criminal proceedings against another defendant cannot be considered relevant in their case, insofar as they have not been formally notified of any charge against that defendant for the crimes committed in Tihovići and, to date, no one has been investigated, judged or sanctioned for those crimes.
ويدَّعي صاحبا البلاغ كذلك أن الدعوى الجنائية الجارية ضد متهم آخر لا يمكن اعتبارها ذات صلة بخصوص قضيتهما، نظراً إلى أنهما لم يخطَرا رسمياً بتوجيه أية تهمة ضد هذا المتهم عن الجرائم المرتكبة في تيهوفيتشي، وإلى أنه لم يجر حتى الآن، التحقيق مع أحد أو محاكمته أو معاقبته بشأن تلك الجرائم.
