However, regarding a possible extension of the functions of depositaries in the case of " manifestly impermissible reservations " , it was necessary to remember that any draft guideline on that subject should be in accordance with the aforementioned treaty rules, since the Commission was not preparing a new treaty, but only a set of draft guidelines based on existing treaty regulations.

2. Draft guidelines 97. A number of delegations expressed concern about draft guideline 2.1.8 ( " Procedure in case of manifestly [impermissible] reservations " ), since it allowed the depositary to judge or express a view on the impermissibility of a reservation; while the depositary should remain neutral and impartial in the exercise of his functions in keeping with the provision of article 77 of the 1969 Vienna Convention.
