This recommendation is useful for scientifically and correctly defining and limiting the scope of " bona fide third party " in the effort to fight against illicit trafficking of cultural objects, and useful for facilitating and undertaking the recovery of cultural objects which have been trafficked illicitly.
ولهذه التوصية فائدتها في التعريف العلمي الصحيح لنطاق " الأطراف الثالثة حسنة النيّة " في مسعى لمكافحة الاتجار غير المشروع بالممتلكات الثقافية، وكذلك في تسهيل وإنجاز عملية استرداد الممتلكات الثقافية التي تم الاتجار بها بطرائق غير مشروعة.

In paragraph 7 of its resolution 2008/23, the Economic and Social Council urged Member States to take effective measures to prevent the transfer of illicitly acquired or illegally obtained cultural property, especially through auctions, including through the Internet, and to effect its return or restitution to its rightful owners.
22- حثّ المجلسُ الاقتصادي والاجتماعي في الفقرة 7 من قراره 2008/23 الدولَ الأعضاء على اتخاذ تدابير فعّالة لمنع نقل ملكية الممتلكات الثقافية المقتناة بطرائق غير مشروعة أو المتحصل عليها بطرائق غير قانونية، ولا سيما من خلال المزادات، بما فيها مزادات الإنترنت، وإعادتها أو ردها إلى بلدانها الأصلية.

Concerned that demand for stolen, looted and illicitly exported or imported cultural property is growing and fuels further looting, destruction, removal and theft of and trafficking in such unique property, and recognizing that urgent and commensurate legislative and administrative measures are required to discourage demand for illicitly acquired cultural property in the market,

Conscious of the need to enhance international cooperation to effectively prevent, detect and deter international transfers of illicitly acquired assets resulting from transnational organized crime, including, as appropriate, drug trafficking and related offences provided for in the United Nations Convention against Transnational Organized Crime,

A person or institution that acquires movable cultural property stolen or illicitly exported from the requesting State Party shall be entitled to fair compensation in restitution, provided that the possessor neither knew nor ought reasonably to have known that the property was stolen or illicitly exported and can prove that it exercised due diligence when acquiring the property.
ويكون للشخص الذي يقتني، أو المؤسسة التي تقتني، الممتلكات الثقافية المسروقة أو المصدّرة بطرائق غير مشروعة من الدولة الطالبة الحقُّ في الحصول على تعويض عادل عند الاسترداد، بشرط ألاّ يكون الحائز على علم أو يُفترض في حدود المعقول أنه لم يكن على علم بأنَّ الممتلكات مسروقة أو مصدّرة بطرائق غير مشروعة ويمكنه إثبات بذله العناية الواجبة عند اقتناءه الممتلكات.

Without prejudice to the right of a person or institution that acquires stolen or illicitly exported movable cultural property to appropriate compensation, the requested State Party shall use the legal resources available to it to ensure that the person who transferred the property, or any other previous transferrer, is the one who shall pay such compensation.
وتستخدم الدولةُ الطرف المطالَبة، دون المساس بحق الشخص الذي يقتني أو المؤسسة التي تقتني الممتلكات الثقافية المنقولة المسروقة أو المصدّرة بطرائق غير مشروعة في الحصول على تعويض ملائم، المواردَ القانونية المتاحة لها لضمان أن يكون الشخص الذي نقل ملكية الممتلكات، أو أيِّ شخص قبله قام بنقل الملكية، هو من يقوم بسداد هذا التعويض.

(c) Provisions under which a person who transfers a stolen or illicitly exported cultural object shall be the one, in principle, to pay the appropriate compensation to a possessor in good faith and also provisions under which a requested State should adopt measures to that end (i.e., that a requested State should undertake greater commitments to a requesting State);
(ج) أحكام يكون بمقتضاها الشخص الذي يقوم بنقل ملكية ممتلكات ثقافية مسروقة أو مصدّرة بطرائق غير مشروعة هو من يدفع، من حيث المبدأ، التعويض الملائم إلى الحائز بحسن نيّة، وكذلك أحكام يمكن بمقتضاها للدولة المطالَبة اعتماد التدابير التي تحقّق هذه الغاية (أي أنه على الدولة المطالَبة التعهد بالتزامات أكبر للدولة الطالبة)؛

(d) Provisions under which a requesting State has the right to claim compensation against a person who transfers a stolen or illicitly exported cultural object with a view to receiving reimbursement of any compensation paid to a possessor in good faith and under which a requested State should adopt measures to that end (i.e., that a requested State should undertake greater commitments to a requesting State);
(د) أحكام يكون للدولة الطالبة بمقتضاها الحق في المطالبة بالتعويض من الشخص الذي قام بنقل ملكية الممتلكات الثقافية المسروقة أو المصدّرة بطرائق غير مشروعة بهدف الحصول على مبالغ لتسديد أية تعويضات دُفعت إلى الحائز بحسن نيّة، وينبغي للدولة المطالَبة بمقتضاها أن تعتمد التدابير التي تحقّق هذه الغاية (أي أنه على الدولة المطالَبة التعهّد بالتزامات أكبر للدولة الطالبة)؛
