166- تحث المفوضة السامية جميع أطراف النزاع على التقيد الكامل وغير المشروط بقواعد القانون الإنساني الدولي.

It is generally recognised that NSAs are bound by customary rules of IHL and that international legal regimes are evolving to deal with the nature of contemporary conflict.
ومن الأمور المسلم بها عامة أن الجهات الفاعلة غير الدول ملزمة بقواعد القانون الإنساني الدولي العرفية(2) وأن النظم القانونية الدولية تتطور من أجل التعامل مع طبيعة الصراعات المعاصرة.

“In situations of armed conflict, the parties to the conflict shall be bound by the rules of international humanitarian law, and this Convention shall therefore not apply.” A/C.6/53/WG.1/INF/1, ninth paragraph.

It calls upon the parties to cooperate fully in ensuring the unimpeded delivery of humanitarian assistance to all Angolans throughout the country, to take all necessary measures to ensure the security and safety of United Nations and other personnel involved in humanitarian relief operations, and strictly to abide by applicable rules of international humanitarian law.
ويطلب الى اﻷطراف أن تتعـاون تعاونا كاملا في ضمان إيصال المساعدات الانسانية دون عائق إلى جميع اﻷنغوليين في جميع أنحاء البلد، وأن تتخذ جميع التدابير اللازمة لضمان أمن وسلامة اﻷفراد التابعين لﻷمم المتحدة وغيرهم المشتركين في عمليات اﻹغاثة الانسانية وأن تلتزم بدقة بقواعد القانون اﻹنساني الدولي المنطبقة.

Recalling the rules of international humanitarian law on the protection of victims of armed conflict, especially the four Geneva Conventions of 12 August 1949 and their two additional protocols of 1977;

٣١ - يكرر مناشدته للطرفين أن يتقيدا تقيدا دقيقا بقواعد القانون اﻹنساني الدولي المعمول بها، بما في ذلك أن يضمنا إتاحة وصول المساعدة اﻹنسانية دون إعاقة إلى السكان المدنيين المحتاجين إليها، ويثني بوجه خاص على الجهود التي يبذلها اﻷمين العام وممثلته الخاصة ﻹنشاء ممرات إغاثة إنسانية متفق عليها؛

ويطلب الى اﻷطراف أن تتعـاون تعاونا كاملا في ضمان توصيل المساعدات الانسانية الى جميع اﻷنغوليين في جميع أنحاء البلد دون وضع أية عراقيل، وأن تتخذ جميع التدابير اللازمة لضمان أمن وسلامة اﻷفراد التابعين لﻷمم المتحدة وغيرهم المشتركين في عمليات اﻹغاثة الانسانية وأن تلتزم بدقة بقواعد القانون اﻹنساني الدولي السارية.

Last July in Geneva, our Committee convened the United Nations International Meeting on the Question of Palestine to look into the initial results of those investigations, with the stated goal of strengthening adherence to the norms of international humanitarian law.
وفي تموز/يوليه الماضي، دعت لجنتنا في جنيف إلى عقد اجتماع الأمم المتحدة الدولي بشأن القضية الفلسطينية للنظر في النتائج الأولية لتلك التحقيقات بهدف معلن وهو تعزيز التقيد بقواعد القانون الإنساني الدولي.

10. The most effective way to ensure that NSAs adhere to the rules of IHL concerning the irresponsible use of weapons is to educate them about the principles of IHL and about the mutually beneficial nature of its provisions.
10- تتمثل أكثر الوسائل فعالية لضمان تقيد الجهات الفاعلة غير الدول بقواعد القانون الإنساني الدولي المتعلقة بالاستخدام غير المسؤول للأسلحة في تثقيفها بمبادئ القانون الإنساني الدولي وبطبيعة أحكامه التي تعود بالنفع على الجميع.

Some experts encouraged direct engagement with non-State actors to raise awareness of IHL rules and deter violations, but recognised that this was challenging particularly in the context of non-international armed conflicts.
وشجع بعض الخبراء التعامل المباشر مع الجهات الفاعلة من غير الدول من أجل التوعية بقواعد القانون الإنساني الدولي وردع الانتهاكات، لكنهم اعترفوا بأن ذلك أمر صعب لا سيما في سياق النزاعات المسلحة غير الدولية.
