Having concluded its consideration of communication No. 857/1999 submitted to the Human Rights Committee by Messrs. Miroslav Blazek, George A. Hartman and George Krizek under the Optional Protocol to the International Covenant on Civil and Political Rights,

2.2 Mr. Miroslav Blazek states that he is precluded from claiming his inheritance, including real property in Prague and agricultural property in Plana-nod-Luznici because he is not a Czech citizen.

The Committee has followed these views in subsequent cases, including Adam v. The Czech Republic, No. 586/1994; Blazek et al. v. The Czech Republic, No. 857/1999; and Des Fours Walderode v. The Czech Republic, No. 747/1997.

In the Czech Republic, not only are education differentials in mortality large, but they have also widened over time (Blazek and Dzurova, 1997; Bobak and others, 1997).

In the circumstances, the Committee finds that article 5, paragraph 2 (b), of the Optional Protocol does not preclude the Committee's consideration of the communications of Messrs. Blazek, Hartman and Krizek.

6. The Human Rights Committee, acting under article 5, paragraph 4, of the Optional Protocol to the International Covenant on Civil and Political Rights, is of the view that the facts before it disclose a violation or article 26, in relation to Messrs. Blazek, Hartman, and Krizek.

With respect to the following cases: Simunek et al - 516/1992; Adam - 586/1994; Blazek - 857/1999; Marik - 945/2000; and Kříž - 1054/2000; the State party informs the Committee that the modification of legislation removing the nationality condition would not be supported by Parliament as such an amendment would have to be retrospective, thereby opening the entire restitution process.
