5. Article 2 establishes the principle that if a State engages in a commercial transaction with a foreign natural or juridical person and, by virtue of the applicable rules of private international law, differences relating to the commercial transaction fall within the jurisdiction of a court of another State, the State cannot invoke immunity from that jurisdiction in a proceeding arising out of that commercial transaction.
5 - تنشئ المادة 2 المبدأ القائل بأنه إذا قامت دولة من الدول بمعاملة تجارية مع شخص طبيعي أو اعتباري أجنبي، وكانت الخلافات المتصلة بالمعاملة التجارية تخضع لولاية محكمة في دولة أخرى، بموجب القواعد السارية للقانون الدولي الخاص، فإن الدولة لا تستطيع أن تحتج بالحصانة من تلك الولاية في أي إجراء قضائي ينشأ عن تلك المعاملة التجارية.
