42. The Human Rights Committee has indicated that while States have the obligation under the International Covenant on Civil and Political Rights to ensure the equal right of men and women to the enjoyment of their Covenant rights, legislation or administrative measures adopted by States to regulate matters other than those dealt with in the Covenant could have a negative effect on the equal enjoyment of human rights by women.
42- وأفادت اللجنة المعنية بحقوق الإنسان بأنه رغم التزام الدول بمقتضى العهد الدولي الخاص بالحقوق المدنية والسياسية بكفالة تساوي حقوق الرجال والنساء في التمتع بحقوقهم بموجب العهد، فقد يكون للتدابير التشريعية أو الإدارية، التي وُضِعت خصيصاً لتنظيم أمور غير تلك التي يتناولها العهد، أثر سلبي في مساواة النساء في التمتع بحقوق الإنسان.

(a) To comply fully with their obligations under the International Covenant on Civil and Political Rights and the Convention on the Rights of the Child, notably not to impose the death penalty for any but the most serious crimes, not to impose it for crimes committed by persons below eighteen years of age, to exclude pregnant women from capital punishment and to ensure the right to seek pardon or commutation of sentence;
)أ( أن تمتثل امتثالاً تاماً لالتزاماتها بمقتضى العهد الدولي الخاص بالحقوق المدنية والسياسية واتفاقية حقوق الطفل، وتحثها بصفة خاصة على عدم فرض عقوبة اﻹعدام إلا عقاباً على أشد الجرائم خطورة، وألا تفرضها عقاباً على الجرائم التي ارتكبها أشخاص دون سن الثامنة عشرة، وأن تستبعد الحوامل من عقوبة اﻹعدام، وأن تؤمﱢن الحق في التماس العفو أو تخفيف الحكم؛

" (c) The use of the death penalty for crimes other than the most serious and in disregard of the obligations assumed by the Government of the Sudan under the International Covenant on Civil and Political Rights, bearing in mind the provisions of the safeguards guaranteeing protection of the rights of those facing the death penalty, including the passing of death sentences without legal representation and summary executions;
