1. An injured State or an injured international organization may only take countermeasures against an international organization which is responsible for an internationally wrongful act in order to induce that organization to comply with its obligations under Part Three.
1 - لا يجوز للدولة أو المنظمة الدولية المتضررة أن تتخذ تدابير مضادة تجاه منظمة دولية مسؤولة عن فعل غير مشروع دوليا إلا من أجل حمل تلك المنظمة على الامتثال لالتزاماتها المقررة بموجب الباب الثالث.

تنهى التدابير المضادة حالما تمتثل المنظمة الدولية المسؤولة لالتزاماتها المقررة بموجب الباب الثالث فيما يتصل بالفعل غير المشروع دوليا.

1. An injured State or an injured international organization may only take countermeasures against an international organization which is responsible for an internationally wrongful act in order to induce that organization to comply with its obligations under Part Three.
1- يجوز للدولة أو المنظمة الدولية المضرورة أن تتخذ تدابير مضادة تجاه منظمة دولية مسؤولة عن فعل غير مشروع دولياً لغرض واحد هو حمل هذه المنظمة على الامتثال لالتزاماتها المقررة بموجب الباب الثالث.

(b) No appropriate means are available for otherwise inducing compliance with the obligations of the responsible organization under Part Three.
(ب) لم تتوافر وسائل ملائمة لحمل المنظمة المسؤولة، بطريقة أخرى، على الامتثال لالتزاماتها المقررة بموجب الباب الثالث.

The idea underlying these two paragraphs is that, when the parties to a dispute concerning international responsibility have agreed to entrust the settlement of the dispute to a body which has the authority to make binding decisions, the task of inducing the responsible international organization to comply with its obligations under Part Three will rest with that body.
والفكرة الكامنة وراء هاتين الفقرتين هي أنه عند موافقة الطرفين في نزاع يتعلق بالمسؤولية الدولية على أن يعهدا إلى هيئة تملك اتخاذ قرارات ملزمة بتسوية النزاع، تكون هذه الهيئة هي المسؤولة عن حمل المنظمة الدولية المسؤولة على الامتثال لالتزاماتها المقررة بموجب الباب الثالث.

Since the object of countermeasures is to induce an international organization to comply with its obligations under Part Three with regard to an internationally wrongful act for which that organization is responsible, countermeasures are no longer justified and have to be terminated once the responsible organization has complied with those obligations.
وبما أن موضوع التدابير المضادة هو حمل المنظمة الدولية على الامتثال لالتزاماتها المقررة بموجب الباب الثالث فيما يتعلق بالفعل غير المشروع دولياً الذي تكون المنظمة مسؤولة عنه، فإنه لا يوجد ما يبرر استمرار التدابير المضادة، بل وينبغي إنهاؤها، بمجرد امتثال المنظمة المسؤولة لتلك الالتزامات.

7. The draft articles provided that an injured State that took countermeasures must fulfil its dispute settlement obligations under Part Three of the draft or any other mandatory dispute settlement procedure in force between the States concerned.
7 - ومضى يقول إن مشاريع المواد تنص على أنه يتعين على الدولة المضرورة التي تتخذ تدابير مضادة أن تـفي بالتزاماتها بتسوية النزاع بموجب الباب الثالث من المشروع أو أي إجراء إلزامي لتسوية النزاع سارٍ بين الدول المعنية.

2. An injured State taking countermeasures shall fulfil the obligations in relation to dispute settlement arising under Part Three or any other binding dispute settlement procedure in force between the injured State and the State which has committed the internationally wrongful act.
2 - تستوفي الدولة المضرورة التي تتخذ تدابير مضادة الالتزامات المتعلقة بتسوية المنازعات الناشئة بموجب الباب الثالث أو أي إجراء آخر ملزم لتسوية المنازعات يكون ساريا بين الدولة المضرورة والدولة التي ارتكبت الفعل غير المشروع دوليا.

Any third-party body called upon to deal with a dispute under Part Three (conciliation commission, arbitral tribunal or the Court) would be empowered by the future convention not only, as noted above, to order interim measures but also to suspend any measures previously taken by the allegedly injured State.
فأية هيئة تشكل طرفا ثالثا تدعى الى معالجة نزاع بموجب الباب الثالث )لجنة التوفيق أو هيئة التحكيم أو المحكمة( ستكون مخولة بموجب الاتفاقية المقبلة لا أن تأمر بالتدابير المؤقتة فحسب، كما تقدم ذكره، بل كذلك أن تعلق أية تدابير سبق أن اتخذتها الدولة التي يدعى أنها مضرورة.
