Variant 1 provided for an application of the rules on transparency to arbitration irrespective of the applicable arbitration rules. Variant 2 limited the scope of application of the rules on transparency to arbitration under the UNCITRAL Arbitration Rules.

It was pointed out that some States referred to the UNCITRAL Arbitration Rules in their respective laws or investment contracts, providing the example of a State that included in new oil contracts the possibility of ad hoc arbitration under the UNCITRAL Arbitration Rules.
وقيل إنَّ بعض الدول تشير إلى قواعد الأونسيترال للتحكيم في قوانينها أو عقودها الاستثمارية، وذُكرت كمثال على ذلك دولة أدرجت في عقود النفط الجديدة التي أبرمتها إمكانية اللجوء إلى التحكيم المخصَّص بموجب قواعد الأونسيترال للتحكيم.
