From a more practical point of view, it should be noted that, since the hosting of foreign armed forces was often a highly controversial matter for the host State, there might arise random proceedings against foreign armed forces in the host State, should the scope of applicability of the principle of State immunity be uniformly limited under the draft convention.
٧٧ - ومضت إلى القول إنه، من وجهة نظر أكثر عملية، ينبغي ملاحظة أنه نظرا لكون استضافة قوات مسلحة أجنبية إنما هي في الغالب مسألة تثير الجدل الشديد بالنسبة للدولة المضيفة، فمن المحتمل أن تثار اعتباطا دعاوى ضد القوات المسلحة اﻷجنبية في الدولة المضيفة، إذا كان نطاق انطباق مبدأ حصانة الدول ليكون محصورا على نحو موحد بموجب مشروع الاتفاقية.

Another view was that if an assignment was invalid, the debtor could not be discharged by payment to the person or to the address identified in the notification, since the “notification” would not be a notification in the sense of draft article 16(3) and “the assignee” would not be an assignee under the draft convention.
