Article 11, paragraph 1, of the draft adopted by the Commission in 1991 laid down the general principle that, unless otherwise agreed between the States concerned, a State could not invoke immunity from jurisdiction before a court of another State which was otherwise competent in a proceeding which related to a contract of employment.
وتحدد الفقرة 1 من المادة 11 من المشروع الذي اعتمدته لجنة القانون الدولي في عام 1991 القاعدة التي لا تستطيع الدولة بموجبها أن تتمسك بالحصانة من الولاية القضائية أمام محكمــة دولــة أخــرى، مختصــة في هذا المجال، في إجــراءات متعلقة بعقد عمل، ما لم تتفق الدولتان المعنيتان على خلاف ذلك.

In urgent circumstances and where agreed by the States Parties, requests may be made orally, but shall be confirmed in writing forthwith.
وفي الحالات العاجلة، وحيثما تتفق الدولتان الطرفان على ذلك، يجوز أن تقدم الطلبات شفويا، على أن تُؤكد كتابة على الفور.

1 - لا يجوز لدولة تملك سفينة أو تشغِّلها أن تحتج بالحصانة من الولاية القضائية أمام محكمة دولة أخرى، تكون من جميع الوجود الأخرى هي المحكمة المختصة، في دعوى تتصل بتشغيل تلك السفينة إذا كانت السفينة، وقت نشوء سبب الدعوى، مستخدمة في غير الأغراض الحكومية غير التجارية، وهذا ما لم تتفق الدولتان المعنيتان على غير ذلك.
