ويكمن مفعول المادتين 38 و39 في أن جميع الممتلكات المشبوهة العائدة إلى أشخاص مدانين أو متَّهمين بارتكاب جرائم أو مشتبه في ارتكابهم جرائم خطيرة يجوز تجميدها أو ضبطها بناءً على طلب صادر من النائب العام.

The Summit further recommends that States should consider concluding agreements or arrangements on asset-sharing with countries involved in tracing, freezing or seizure and confiscation of assets originating from organized crime activities.

The Summit also recommends that States should take decisive steps to improve international cooperation for purposes of confiscation and afford, to that effect, the widest possible assistance to other countries in relation to the identification, tracing, freezing or seizure and confiscation of proceeds of serious crime, as well as property, equipment or other instrumentalities used in or destined for use in the commission of a criminal offence.
43- يوصي مؤتمر القمة أيضا بأن تقوم الدول بخطوات حاسمة لتحسين التعاون الدولي لأغراض المصادرة، وأن تقدّم لهذا الغرض أوسع مساعدة ممكنة للبلدان الأخرى فيما يتعلق بتحديد عائدات الجرائم الخطيرة أو تعقّبها أو تجميدها أو ضبطها ومصادرتها، وكذلك الممتلكات أو المعدات أو الأدوات الأخرى المستخدمة أو المقصود استخدامها في ارتكاب أعمال إجرامية.

2. States Parties shall adopt such measures as may be necessary to enable the identification, tracing, freezing or seizure of any item referred to in paragraph 1 of this article for the purpose of eventual confiscation. The delegation of Cyprus noted that this article and paragraph should also cover provisional measures even in cases where no confiscation took place.
٢ - يتعين على الدول اﻷطراف أن تعتمد ما يلزم من تدابير للتمكين من كشف أي من العائدات المشار إليها في الفقرة ١ من هذه المادة أو تجميدها أو ضبطها ، بغرض مصادرتها في نهاية المطاف .أشار وفد قبرص الى أنه ينبغي لهذه المادة وهذه الفقرة أن تشملا أيضا التدابير المؤقتة ، حتى في الحالات التي لا تحدث فيها مصادرة .

As previously stated, as a general rule frozen or seized assets are protected under Costa Rican legislation because they can be used for various purposes:
