Establishment of jurisdiction by the State of nationality is required in such a case to give effect to paragraph 10 of article 16 (extradition), which obliges a State party when it refuses extradition on the ground of nationality to submit the case without undue delay to its competent authorities for the purpose of prosecution (the principle of aut dedere aut judicare).
ومن الضروري تأكيد سريان الولاية القضائية لدولة الجنسية في مثل تلك الحالة بغية إنفاذ مفعول الفقرة 10 من المادة 16 (تسليم المجرمين) التي توجب على الدولة الطرف، عندما ترفض التسليم على أساس الجنسية، أن تحيل القضية دون إبطاء لا مبرر لـه إلى سلطاتها المختصة بقصد الملاحقة (مبدأ إما التسليم أو المحاكمة).
