It was suggested that wording previously considered by the Working Group along the lines of “An interim measure of protection is any temporary measure, whether in the form of an award or in another form” was preferable.
وارتئي أن الصيغة السابقة التي نظر فيها الفريق العامل والتي كانت على غرار " تدبير الحماية المؤقت هو أي تدبير وقتي، سواء اتخذ شكل قرار تحكيمي أو أي شكل آخر " هي الصيغة المفضلة.

Further questions were raised whether the provision should be amended to clarify that the arbitral tribunal would have the power to modify or terminate an interim measure of protection either upon its own motion or upon request by any other party.

ولا تمس هذه الفقرة الفرعية بالسلطة المخوّلة لهيئة التحكيم في أن توافق على تدبير الحماية المؤقت أو تأكيده أو تمديده أو تعديله بمقتضى الفقرة (1) بعد أن يكون الطرف الذي يوجه التدبير ضده قد أُشعر بذلك وأعطي فرصة لسماع رأيه.

However, it was observed that, even if the words “any party” were used, the text of paragraph (5) would still refer to security being provided “as a condition to granting an interim measure of protection”, thus avoiding any risk that the security would be required from the defendant.
ولكن لوحظ أنه حتى لو استخدمت عبارة " أي طرف " ، فإن نص الفقرة (5) سيظل يشير إلى توفير الضمان " كشرط للموافقة على تدبير الحماية المؤقت " متفاديا بذلك أي احتمال في أن يطلب الضمان من المدّعى عليه.

54. Questions were raised as to whether the reference to the notion of an interim measure of protection in the first sentence of paragraph 7 (f) could create confusion, as paragraph 7 was aimed solely at defining the regime of preliminary orders.
