٣ - أو تلك التي تستخدم طريقة أو وسيلة للقتال لا يمكن حصر آثارها على النحو الذي يتطلبه هذا " البروتوكول " اﻹضافي، ومن شأنها أن تصيب، في كل حالة كهذه، اﻷهداف العسكرية واﻷشخاص المدنيين أو اﻷهداف المدنية دون تمييز.

2. A procuring entity may use a method of procurement other than open tendering only in accordance with articles 29 to 31 of this Law, shall select the other method of procurement to accommodate the circumstances of the procurement concerned and shall seek to maximize competition to the extent practicable.
2- لا يجوز للجهة المشترية أن تستخدم طريقة اشتراء أخرى غير المناقصة المفتوحة إلا وفقا للمواد 29 إلى 31 من هذا القانون، وتختار طريقة الاشتراء الأخرى تلك بما يناسب ظروف الاشتراء المعني، وتسعى إلى زيادة التنافس إلى أقصى مدى ممكن عملياً.

(2) A procuring entity may use a method of procurement other than open tendering only in accordance with articles 28 to 30 of this Law, shall select the other method of procurement to accommodate the circumstances of the procurement concerned, and shall seek to maximize competition to the extent practicable.
(2) لا يجوز للجهة المشترية أن تستخدم طريقة اشتراء أخرى غير المناقصة المفتوحة إلا وفقا للمواد 28 إلى 30 من هذا القانون، وتختار طريقة الاشتراء الأخرى تلك بما يناسب ظروف الاشتراء المعني، وتسعى إلى زيادة التنافس إلى أقصى مدى ممكن عمليا.

162. A suggestion was made to replace the proviso at the end of paragraph (3) by the words: " provided that a method is used to give a reliable assurance that no other data message has been or may be used by the transferor for the purpose of transferring such right or obligation to more than one person at any given time " .
١٦٢ - وقدم اقتراح يدعو إلى الاستعاضة عن الجملة الواردة في نهاية الفقرة )٣( بالعبارة التالية: " شريطة أن تستخدم طريقة تعطي تأكيدات موثوق بها تفيد بأن الناقل لم يستخدم، أو لا يجوز له أن يستخدم، أي رسالة بيانات أخرى ﻷجل نقل هذا الحق أو الواجب الى أكثر من شخص واحد في أي وقت من اﻷوقات " .
