The Committee recommends that the State party strictly observe in all cases article 3 of the Convention requiring that the State party shall not expel, return or extradite a person to another State where there are substantial grounds for believing that the person would be in danger of being subjected to torture.

The Convention provides that a State on whose territory a person suspected of a terrorist bombing crime is found must either prosecute the suspect or extradite him to another State willing to prosecute (art. 8 (1)).
وتنص الاتفاقية على أن الدولة التي يوجد في إقليمها شخص مشتبه في ارتكابه جريمة تفجير إرهابي يجب إما أن تلاحق المشتبه به أو أن تسلمه إلى دولة أخرى تزمع ملاحقته (الفقرة 1 من المادة 8).

12. In accordance with the `aut dedere aut judicare'obligation laid down in Article 11 of the Convention, the Netherlands will, in such circumstances, either itself prosecute and try the person concerned or extradite him to another State which has requested his extradition for the same offences or surrender him to an international criminal tribunal which has requested his surrender.
