كما يطلب من اللجنة أن تطالب الدولة الطرف بإجراء تحقيقات عاجلة ومستقلة بغية: العثور على فريد مشاني؛ (ب) وإحالة المسؤولين عن عملية اختفائه القسري إلى السلطات المدنية المختصة لملاحقتهم قضائياً؛ (ج) وجبر الضرر الذي لحق بفريد مشاني - إذا كان لا يزال على قيد الحياة وبوالديه على نحو مناسب وفعال وفوري.

كما يطلب من اللجنة أن تطالب الدولة الطرف بإجراء تحقيقات عاجلة ومستقلة بغية: (أ) العثور على فريد مشاني؛ (ب) وإحالة المسؤولين عن عملية اختفائه القسري إلى السلطات المدنية المختصة لملاحقتهم قضائياً؛ (ج) وجبر الضرر الذي لحق بفريد مشاني - إذا كان لا يزال على قيد الحياة - وبوالديه على نحو مناسب وفعال وفوري.

Following an exchange of views in which Ms. CHANET, Mr. SHEARER and the CHAIRPERSON took part, Sir Nigel RODLEY suggested that the paragraph should be amended to read, in part: " The legal nature of the obligation imposed on States parties in the light of a decision by the Committee to request the State party to adopt interim measures of protection should be considered separately. " .
17- سير نايجل رودلي: اقترح بعد تبادل الآراء بين السيدة شانيه والسيد شيرير (المقرر المعني بالتعليق العام) والرئيس، بأن تعدل الفقرة 25 بحيث تقرأ على الوجه التالي: " ينبغي النظر بصورة منفصلة في الطابع القانوني للالتزام المفروض على الدول الأطراف مراعاة لقرار اللجنة أن تطالب الدولة الطرف باتخاذ تدابير مؤقتة للحماية " .
