On the assumption that the rules of private international law were implicit in draft article 1, the observer for the Hague Conference on Private International Law had requested clarification of the provision in draft article 18, paragraph 1 (b), to the effect that a State could declare that it would apply the Convention only when the rules of private international law led to the application of the law of a Contracting State.
