The Committee recalls that States parties are under an obligation not to expose individuals to a real risk of being subjected to torture or cruel, inhuman or degrading treatment or punishment upon return to another country by way of their extradition, expulsion or refoulement.
وتذكّر اللجنة بأن الدول الأطراف ملزمة بعدم تعريض الأفراد لخطر حقيقي يتمثل في خضوعهم للتعذيب أو المعاملة أو العقوبة القاسية أو اللاإنسانية أو المهينة لدى عودتهم إلى بلد آخر عن طريق تسليمهم أو طردهم أو إبعادهم.

116. In case No. 1315/2004 (Singh v. Canada), the Committee recalled that States parties had the obligation not to expose individuals to a real risk of being killed or subjected to torture or cruel, inhuman or degrading treatment or punishment upon return to another country by way of their extradition, expulsion or refoulement.
116- وفي القضية رقم 1315/2004 (سينغ ضد كندا)، ذكرت اللجنة بأن الدول الأطراف ملزمة بعدم تعريض الأفراد لخطر محقق يؤدي بهم إلى القتل، أو التعرض للتعذيب، أو المعاملة أو العقوبة القاسية أو اللاإنسانية أو المهينة لدى العودة إلى بلد آخر عن طريق تسليمهم أو طردهم أو إبعادهم.

(c) Operative paragraph 6 (j), which read: " Not to expose individuals to danger of cruel, inhuman or degrading treatment or punishment by way of return to another country insofar as such an act runs contrary to their obligations under international law " ;
(ج) استعيض عن الفقرة 6 (ي) من المنطوق، ونصها كالتالي: " عدم تعريض الأفراد لخطر المعاملة أو العقوبة القاسية أو اللاإنسانية أو المهينة من خلال إعادتهم إلى بلد آخر ما دام ذلك يخالف التزاماتها بموجب القانون الدولي؛ " بما يلي:
