As stated in paragraph 3 above, according to the Working Group's methods of work, adopted in 1991 and approved by the former Commission on Human Rights and the current Human Rights Council, the Working Group may consider deprivation of liberty to be arbitrary in cases falling into one of three categories specified therein.
