1. The Special Rapporteur on the question of torture, Manfred Nowak, who was appointed on 1 December 2004, hereby submits his first report to the Commission on Human Rights, in accordance with resolution 2005/39.

In his first report to the Commission on Human Rights, the Special Rapporteur on the Sudan indicated that he will take into consideration human rights violations committed by parties other than the Sudanese Government.

26. In his first report to the Commission on Human Rights, the Special Rapporteur emphasized that the right to health " should be consistently and coherently applied across all relevant national and international policy-making processes " .

28. In his first report to the Commission on Human Rights, the Special Rapporteur draws attention to the importance of maintaining the focus on and remaining vigilant against continuing practices that erode the absolute prohibition of torture in the context of counter-terrorism measures.
28- يسترعي المقرر الخاص، في تقريره الأول إلى لجنة حقوق الإنسان، الانتباه إلى أهمية مواصلة التنبه لاستمرار الممارسات التي تؤدي إلى تآكل الحظر المطلق للتعذيب في سياق تدابير مكافحة الإرهاب.

9. Since the Special Rapporteur submitted his first report to the Commission on Human Rights, there has been an increase in the number of replies from Governments to his urgent appeals and communications.
9 - ومنذ أن قدم المقرر الخاص تقريره الأول إلى لجنة حقوق الإنسان، حدثت زيادة في عدد الردود الواردة من بعض الحكومات تلبية لما وجهه من نداءات ورسائل عاجلة.

76. Integrate human rights into all skills drain policies. As the Special Rapporteur has consistently argued since his first report to the Commission on Human Rights, the right to health -- and other human rights -- should be integrated into all relevant national and international policymaking.
76 - تعميم حقوق الإنسان في جميع السياسات المتعلقة بنزوح المهارات - كما ظل المقرر الخاص يؤكده باستمرار منذ تقريره الأول إلى لجنة حقوق الإنسان، ينبغي تعميم الحق في الصحة - وحقوق إنسانية أخرى - في أي عملية وطنية أو دولية لاتخاذ قرارات في هذا الشأن.

In this regard, it is relevant to note that the first Special Rapporteur on torture, Peter Kooijmans, in his first report to the Commission on Human Rights recognized that numerous countries produce and export instruments specifically designed to inflict torture.

16. Moreover, Mr. Louis Joinet, independent expert on the situation of human rights in Haiti, presented his first report to the Commission on Human Rights in March 2003 (E/CN.4/2003/116).

3. In choosing this topic, the Special Rapporteur has considered a number of factors, in accordance with the methodology outlined in his first report to the Commission on Human Rights (E/CN.4/2005/45, paras. 18-21).
