432. The remark was also made that even if the same responsibility regime applied to an insurrectional movement and a national liberation movement, the terms could not be equated given the negative connotation of the former and the positive connotation of the latter.
٤٣٢ - ولوحظ أيضا أنه حتى وإن كان نظام المسؤولية ذاته ينطبق على حركة تمردية وحركة تحرير وطني، لا يمكن المساواة بين المصطلحين نظرا لمعنى اﻷول السلبي ومعنى الثاني اﻹيجابي.

435. As regards paragraph 1, it was remarked that the territorial host State could be held responsible for neglecting to prevent acts of an insurrectional movement in its territory against another State.
٤٣٥ - وفيما يتعلق بالفقرة ١، لوحظ أنه يمكن تحميل الدولة المضيفة اﻹقليمية المسؤولية ﻷنها أهملت منع أعمال حركة تمردية في إقليمها ضد دولة أخرى.

The view was also expressed that it was a conceptual error to refer to State responsibility for the acts of an insurrectional movement, in contrast to the failure of the State to take the necessary preventive measures, and that such matters could be adequately addressed in the commentary.
وأعرب أيضا عن رأي مفاده أن اﻹشارة إلى مسؤولية الدول عن أعمال حركة تمردية خطأ مفاهيمي، في مقابل عدم قيام الدولة باتخاذ التدابير الوقائية اللازمة، وأنه يمكن تناول هذه المسائل على النحو الملائم في التعليق.

The view was also expressed that the term " established " should be interpreted to refer to the moment when an insurrectional movement exercised effective control over part of the territory of a State, and that the responsibility of the State continued up until that moment.
وأعرب أيضا عن رأي مفاده أن عبارة " أنشئت " يجب أن تُفسر على أنها تشير إلى اللحظة التي تمارس فيها حركات تمردية سيطرة فعلية على جزء من إقليم دولة، وأن مسؤولية الدولة استمرت حتى تلك اللحظة.

“The conduct of an organ or agent of an insurrectional movement in the territory of a State or in any other territory under its jurisdiction shall not be considered as an act of that State if:
" لا يعتبر فعلا صادرا عن الدولة تصرف جهاز أو موظف تابع لحركة تمردية في إقليم هذه الدولة أو في أي مكان آخر خاضع لولايتها:

1. The conduct of an organ of an insurrectional movement which is established in the territory of a State or in any other territory under its administration shall not be considered as an act of that State under international law.
١ - لا يعتبر فعلا صادرا عن الدولة بمقتضى القانون الدولي تصرف جهاز من أجهزة حركة تمردية قائمة في إقليم هذه الدولة أو في إقليم آخر خاضع لولايتها.

1. The conduct of an organ of an insurrectional movement, established in opposition to a State or to its government, shall not be considered an act of that State under international law unless:
١ - لا يعتبر فعلا صادرا عن الدولة بمقتضى القانون الدولي تصرف جهاز من أجهزة حركة تمردية أنشئت ضد الدولة أو ضد حكومتها ما لم :

32. The issue of the conduct of organs of an insurrectional movement, contained in articles 14 and 15, left considerable doubt, particularly with regard to the provision in article 15, paragraph 1, concerning the attribution of acts of an insurrectional movement to a State.
٣٢ - وأضاف يقول إن مسألة تصرفات أجهزة حركة تمرد الواردة في المادتين ١٤ و ١٥ تثير شكوكا عميقة، ولا سيما فيما يتعلق بالنص الوارد في الفقرة ١ من المادة ١٥ المتعلق بتحميل دولة فعل حركة تمردية.
