In this regard the Committee recalls its general recommendations VII and XV, according to which the prohibition of dissemination of all ideas based upon racial superiority or hatred is compatible with the right to freedom of opinion and expression, given that a citizen's exercise of this right carries special duties and responsibilities, among which is the obligation not to disseminate racist ideas.
وبهذا الخصوص، تشير اللجنة إلى توصيتيها العامتين السابعة والخامسة عشرة اللتين جاء فيهما أن حظر بث جميع الأفكار التي تقوم على التفوق العرقي أو الكراهية العرقية يتماشى مع الحق في حرية الرأي والتعبير، علماً بأن ممارسة المواطن لهذا الحق تستتبع واجبات ومسؤوليات محددة من بينها واجب عدم بث أفكار عنصرية.

The Committee on the Elimination of Racial Discrimination in its general recommendations VII and XV reiterated that these provisions are of a mandatory character.
14- وأعادت لجنة القضاء على التمييز العنصري، في توصيتيها العامتين السابعة والخامسة عشرة تأكيد أن هذه الأحكام لها طابع إلزامي.

The Committee had already explicitly linked discrimination against women and gender-based violence in its general recommendations No. 12 (1989) and No. 19 (1992).

5.2 The author submits that the Committee, through its general recommendations Nos. 12 and 19, has provided significant guidance on issues of violence against women.

The Committee draws the attention of the State party to its general recommendations No. 7 (1985) and 15 (1993) concerning the implementation of article 4 of the Convention, and request the State party to consider withdrawing or narrowing the scope of its reservations to article 4 of the Convention.

In the light of its general recommendations No. 19 (1995) on racial segregation and apartheid and No. 27 (2000) on discrimination against Roma, the Committee recommends that the State party:
توصي اللجنة، في ضوء توصيتيها العامتين رقم 19(1995) بشأن العزل العنصري والفصل العنصري ورقم 27(2000) بشأن التمييز ضد الغجر، بأن تضطلع الدولة الطرف بما يلي:

(c) Raise awareness among media professionals of their responsibility not to disseminate prejudice and to avoid reporting incidents involving non-citizens, members of Roma and Sinti communities in a way that stigmatizes such communities as a whole, bearing in mind its general recommendations No. 27 (2000) and No. 30 (2004).
(ج) بث الوعي في صفوف المهنيين الإعلاميين بشأن مسؤوليتهم عن عدم نشر أفكار تنم عن تحايل وتجنب الإبلاغ عن الحالات التي يتورط فيها أفراد من غير المواطنين وأفراد الروما والسنتي بطريقة تصم هاتين الجماعتين ككل، مع وضع توصيتيها العامتين رقم 27(2000) ورقم 30(2004) في الاعتبار.

The Committee, bearing in mind its general recommendations No. 27 (2000) and No.30 (2004), invites the State party to keep it informed regarding the implementation and impact of the actions under the above-mentioned Strategy.
وتدعو اللجنة الدولة الطرف، واضعة في اعتبارها توصيتيها العامتين رقم 27(2000) ورقم 30(2004)، إلى إبقائها على علم فيما يتعلق بتنفيذ الإجراءات المتخذة في إطار الاستراتيجية المشار إليها أعلاه وبأثرها.

(c) Raise awareness among media professionals of their responsibility not to disseminate prejudice and to avoid reporting incidents involving non-citizens, members of Roma and Sinti communities in a way that stigmatizes such communities as a whole, bearing in mind its general recommendations No. 27 (2000) and No. 30 (2004).
(ج) بث الوعي في صفوف المهنيين الإعلاميين بشأن مسؤوليتهم عن عدم نشر أفكار تنم عن التحيز وتجنب الإبلاغ عن الحالات التي يتورط فيها أفراد من غير المواطنين وأفراد الروما والسنتي بطريقة تصم هاتين الجماعتين ككل، مع وضع توصيتيها العامتين رقم 27(2000) ورقم 30(2004) في الاعتبار.

Bearing in mind its general recommendation No. 15 (1993) on article 4 of the Convention and its general recommendation No. 35 (2013) on combating racist hate speech, the Committee recommends that the State party bring its legal provisions relating to the offence of racial discrimination into line with article 4 of the Convention.
توصي اللجنة الدولة الطرف، آخذة في اعتبارها توصيتيها العامتين رقم 15(1993) بشأن المادة 4 من الاتفاقية، ورقم 35(2013) بشأن مكافحة خطاب التحريض على الكراهية العنصرية، بأن توائم الأحكام المتعلقة بجريمة التمييز العنصري مع ما تنص عليه المادة 4 من الاتفاقية.
