1. Each State Party shall make the commission of an offence covered by this Convention liable to sanctions that take into account the grave nature of those offences.
١ - على كل دولة طرف أن تجعل ارتكاب أي جرم مشمول بهذه الاتفاقية عرضة لجزاءات تراعى فيها خطورة ذلك الجرم .

2. States Parties shall consider providing for the possibility, in appropriate cases, of mitigating punishment of an accused person who provides substantial cooperation in the investigation or prosecution of an offence covered by this Convention.
2- تنظر الدول الأطراف في إتاحة إمكانية اللجوء، في الحالات المناسبة، إلى تخفيف عقوبة الشخص المتهم الذي يقدم عوناً كبيراً في إجراءات التحقيق أو الملاحقة بشأن جرم مشمول بهذه الاتفاقية.

1. Each State Party shall consider providing for the possibility, in appropriate cases, of mitigating punishment of an accused person who provides substantial cooperation in the investigation or prosecution of an offence covered by this Convention.
1- تنظر كل دولة طرف في إتاحة إمكانية اللجوء، في الحالات المناسبة، إلى تخفيف عقوبة الشخص المتهم الذي يقدم عونا كبيرا في إجراءات التحقيق أو الملاحقة بشأن جرم مشمول بهذه الاتفاقية.

2. Each State Party shall consider providing for the possibility, in appropriate cases, of mitigating punishment of an accused person who provides substantial cooperation in the investigation or prosecution of an offence covered by this Convention.
2- تنظر كل دولة طرف في أن تتيح، في الحالات المناسبة، إمكانية تخفيف عقوبة المتهم الذي يقدم عونا كبيرا في عمليات التحقيق أو الملاحقة بشأن جرم مشمول بهذه الاتفاقية.

3. Each State Party shall consider providing for the possibility, in accordance with fundamental principles of its domestic law, of granting immunity from prosecution to a person who provides substantial cooperation in the investigation or prosecution of an offence covered by this Convention.
3- تنظر كل دولة طرف في أن تتيح، وفقا للمبادئ الأساسية لقانونها الداخلي، إمكانية منح الحصانة من الملاحقة القضائية لأي شخص يقدم عونا كبيرا في عمليات التحقيق أو الملاحقة بشأن جرم مشمول بهذه الاتفاقية.

3. Each State Party shall consider providing for the possibility, in accordance with fundamental principles of its domestic law, of granting immunity from prosecution to a person who provides substantial cooperation in the investigation or prosecution of an offence covered by this Convention.
3- تنظر كل دولة طرف في إمكانية منح الحصانة من الملاحقة القضائية، وفقا للمبادئ الأساسية لقانونها الداخلي، لأي شخص يقدم عونا كبيرا في عمليات التحقيق أو الملاحقة بشأن جرم مشمول بهذه الاتفاقية.

(a) Proceeds derived from an offence established in article(s) [...] [alternatively: from an offence covered by this Convention] or property the value of which corresponds to that of such proceeds;

1. Each State Party shall make the commission of an offence covered by this Convention The use of the phrase “an offence covered by this Convention” should be reviewed once the scope of the Convention has been determined.
١ - يتعين على كل دولة طرف أن تجعل ارتكاب أي جرم مشمول بهذه الاتفاقيةحالما يتم تحديد نطاق الاتفاقية ، ينبغي اعادة النظر في استخدام عبارة " جرم مشمول بهذه الاتفاقية " .

١- يتعين على كل دولة طرف أن تجعل ارتكاب أي جرم مشمول بهذه الاتفاقيةحالما يتم تحديد نطاق الاتفاقية ، ينبغي اعادة النظر في استخدام عبارة " جرم مشمول بهذه الاتفاقية " .

2. Each State Party shall consider providing [in their domestic law] for the possibility, in appropriate cases, of mitigating punishment of an accused person who provides substantial cooperation in the investigation or prosecution of an offence covered by this Convention.
2- تنظر كل دولة طرف في أن تتيح [في قانونها الداخلي]،() في الحالات المناسبة، إمكانية تخفيف عقوبة المتهم الذي يقدم عونا كبيرا في عمليات التحقيق أو الملاحقة بشأن جرم مشمول بهذه الاتفاقية.

1. A State party that has received a request from another State party having jurisdiction over an offence covered by this Convention for the confiscation of the proceeds of crime, property, equipment or other instrumentalities referred to in article 22 of this Convention situated in its territory shall, to the greatest extent possible within its domestic legal system:
1 - على الدولة الطرف التي تتلقى طلبا من دولة طرف أخرى لها ولاية قضائية على جرم مشمول بهذه الاتفاقية من أجل مصادرة ما يوجد في إقليمها من عائدات إجرامية أو ممتلكات أو معدات أو أدوات أخرى مشار إليها في المادة 22 من هذه الاتفاقية، أن تقوم، إلى أقصى مدى ممكن في إطار نظامها القانوني الداخلي، بما يلي:

(b) Property, equipment or other instrumentalities used in or intended for use in an offence established in article(s) [...] [alternatively: in an offence covered by this Convention].
)ب( الممتلكات أو المعدات أو غيرها من الوسائط المستخدمة ، أو كان يعتزم استخدامها ، في ارتكاب جرم مقرر في المادة )المواد( ]...[ ]أو بدلا من ذلك : جرم مشمول بهذه الاتفاقية[

(a) Proceeds derived from an offence established in article(s) [...] [alternatively: from an offence covered by this Convention] or property the value of which corresponds to that of such proceeds;

3. Each State Party shall consider providing for the possibility, in accordance with fundamental principles of its domestic law, [of granting immunity] from prosecution to [of exempting from criminal responsibility] a person who provides substantial cooperation in the investigation or prosecution of an offence covered by this Convention.
3- تنظر كل دولة طرف في أن تتيح، وفقا للمبادئ الأساسية لقانونها الداخلي، إمكانية [منح الحصانة] من الملاحقة القضائية [للاعفاء من المسؤولية الجنائية]() لأي شخص يقدم عونا كبيرا في عمليات التحقيق أو الملاحقة بشأن جرم مشمول بهذه الاتفاقية.

(j) “Controlled delivery” means the technique of allowing illicit or suspect consignments [of ...] to pass out of, through or into the territory of one or more countries, with the knowledge and under the supervision of their competent authorities, with a view to identifying persons involved in the commission of an offence established in article(s) [...] [alternatively: of an offence covered by this Convention].
)ي( يقصد بتعبير " التسليم المراقب " اﻷسلوب الذي يسمح لشحنة غير مشروعة أو مشبوهة ]من ...[ بالخروج من اقليم بلد أو أكثر أو المرور عبره أو دخوله ، بمعرفة سلطاته المختصة وتحت مراقبتها ، بغية كشف هوية اﻷشخاص الضالعين في ارتكاب جرم مقرر في المادة )المواد( ]...[ ]البديل : جرم مشمول بهذه الاتفاقية[ ؛

“Each State Party shall adopt legislative and other measures, as may be necessary, to establish as criminal offences the conduct constituting the perpetration of any crime covered by this Convention from its own territory in the territory of any other State by an organized criminal group or a member thereof.”
" على كل دولة طرف أن تعتمد ما قد يلزم من تدابير تشريعية وغير تشريعية لتجريم أي سلوك يمثل ارتكابا ﻷي جرم مشمول بهذه الاتفاقية انطلاقا من اقليمها في اقليم أي دولة أخرى من جانب جماعة اجرامية منظمة أو من جانب عضو فيها . "

5. In a case where more than one State claims jurisdiction over an offence covered by the present Convention, the States concerned [shall seek] to coordinate their actions in an effective manner, in particular regarding the conditions of exercising prosecution and the modalities of recourse to mutual assistance. It was suggested that there should be provision for the settlement of disputes over jurisdiction.
٥ - في حالة ادعاء أكثر من دولة سريان ولايتها القضائية على جرم مشمول بهذه الاتفاقية ، يتعين على الدول المعنية ]أن تسعى الى تنسيق[ ]أن تنسق[ تدابيرها بطريقة فعالة ، خصوصا فيما يتعلق بشروط ممارسة الملاحقة وطرائق اللجوء الى تبادل المساعدة .اقترح ادراج حكم بشأن تسوية المنازعات المتعلقة بالولاية القضائية .
